AN  ACT  to  amend  the  administrative code of the city of New York, in
  relation to the removal of raccoons

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1.  The administrative code of the city of New York is amended
by adding a new section 17-198 to read as follows:
  S  17-198  RACCOON  REMOVAL. A. THE DEPARTMENT SHALL ENSURE THE PROMPT
REMOVAL OF ANY RACCOON FROM ANY OUTDOOR PUBLIC OR PRIVATE PROPERTY  UPON
RECEIVING A REQUEST FOR SUCH REMOVAL FROM A MEMBER OF THE PUBLIC.
  B. THE DEPARTMENT SHALL COORDINATE THE HUMANE RELEASE OF RACCOONS WITH
THE  DEPARTMENT  OF  PARKS  AND RECREATION, PROVIDED THAT THE DEPARTMENT
DEEMS THE RELEASE APPROPRIATE, IN  ACCORDANCE  WITH  THE  RULES  OF  THE
DEPARTMENT.
  C.  THE  DEPARTMENT SHALL PROMULGATE SUCH RULES AS MAY BE NECESSARY TO
IMPLEMENT THE PROVISIONS OF THIS SECTION.
  S 2. This act shall take effect immediately.

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1.  The administrative code of the city of New York is amended
by adding a new section 17-198 to read as follows:
  S  17-198  RACCOON  REMOVAL. A. THE DEPARTMENT SHALL ENSURE THE PROMPT

RECEIVING  NOTICE FROM A MEMBER OF THE PUBLIC THAT A RACCOON OR RACCOONS
HAVE CREATED A NUISANCE AT SUCH PROPERTY.
  B. THE DEPARTMENT SHALL COORDINATE THE HUMANE RELEASE OF RACCOONS WITH
THE DEPARTMENT OF PARKS AND RECREATION,  PROVIDED  THAT  THE  DEPARTMENT
DEEMS THE RELEASE POSES NO THREAT TO PUBLIC HEALTH OR SAFETY, IN ACCORD-
ANCE WITH THE RULES OF THE DEPARTMENT.
  C.  THE  DEPARTMENT SHALL PROMULGATE SUCH RULES AS MAY BE NECESSARY TO
IMPLEMENT THE PROVISIONS OF THIS SECTION.
  S 2. This act shall take effect immediately.
