Requires physicians who have treated a child for toy-related injuries to notify the state consumer protection board of such toy-related injuries within seventy-two hours of treatment; requires the department of health to prepare a form for making such notification; requires the department of health to make this form available to physicians and hospitals across the state.

AN ACT to amend the public health law, in relation to reporting  toy-re-
  lated injuries

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The public health law is amended by adding  a  new  section
212 to read as follows:
  S  212.  REPORTING  TOY-RELATED  INJURIES.  1.  EACH PHYSICIAN WHO HAS
TREATED A CHILD FOR A TOY-RELATED INJURY OUTSIDE OF  AN  EMERGENCY  ROOM
AND  HOSPITAL  OR  IN THE CASE OF TREATMENT OF A CHILD FOR A TOY-RELATED
INJURY IN A HOSPITAL EMERGENCY ROOM SHALL WITHIN  SEVENTY-TWO  HOURS  OF
SUCH  TREATMENT  NOTIFY THE STATE CONSUMER PROTECTION BOARD OF THE INCI-
DENT.
  2. THE DEPARTMENT SHALL PREPARE A FORM  FOR  MAKING  THE  NOTIFICATION
REQUIRED  BY  SUBDIVISION  ONE  OF THIS SECTION AND SHALL MAKE SUCH FORM
AVAILABLE TO PHYSICIANS AND HOSPITALS ACROSS THE STATE.  THE  DEPARTMENT
MAY PROMULGATE RULES AND REGULATIONS REGARDING THE NOTIFICATION REQUIRED
BY  SUCH SUBDIVISION ONE AS ARE NECESSARY AND APPROPRIATE TO MAKING SUCH
NOTIFICATION EFFECTIVE AS A MEANS TO IDENTIFY UNSAFE  TOYS  AND  PROVIDE
ACCURATE INJURY DATA.
  S 2. This act shall take effect on the one hundred eightieth day after
it  shall have become a law. Effective immediately, the addition, amend-
ment and/or repeal of any rule or regulation necessary for the implemen-
tation of this act on its effective date are authorized and directed  to
be made and completed on or before such effective date.
