BILL NUMBER:S2570 TITLE OF BILL: An act to repeal paragraph (f) of subdivision 2 of section 210 of the civil service law, relating to the prohibition of strikes by public employees and individual penalties SUMMARY: This bill repeals the penalty of two days pay for each day a public employee participates in a strike. JUSTIFICATION: Enactment of this bill would remove from the Taylor Law the excessively punitive penalty of the loss of the second day's pay for each day of a strike. The bill would NOT repeal the prohibition of strikes. Public employee strikes will continue to be penalties for striking. In addition to loss of the second day's pay for each day of a strike, state law includes the following provisions: fines and imprisonment imposed by the courts upon individuals (judiciary Law, Section 751, subdivision 2) -removal or other disciplinary action against individuals (Civil Service Law, Section 210, subdivision 2) -loss of payroll deduction of dues by the employee organization (Civil Service Law, Section 210, subdivision 3) None.

KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to repeal paragraph (f) of subdivision 2 of section 210 of the civil service law, relating to the prohibition of strikes by public employees and individual penalties THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (f) of subdivision 2 of section 210 of the civil service law is REPEALED. S 2. This act shall take effect immediately.
