BILL NUMBER:S2823 TITLE OF BILL: An act to amend the legislative law, in relation to prohibiting the withdrawal or reduction of promised funds for community projects after the departure of the original sponsoring member PURPOSE: This Legislature addresses a community organization's right to receive legislative initiative funding, also known as member item funding, which is pledged to it, even when Legislator committing such funding is no longer in office, provide that all funding criteria is met and approved by the sponsoring agency. SUMMARY OF PROVISIONS: This legislation amends the legislative law by adding a new section 13 to prevent the withdrawal of promised funding to community based organizations by a member of the Legislature, without the consent and approval of the new elected official who represents the district where the community group is located. JUSTIFICATION: There have been several instances whereby community based organizations that were promised funding by an elected official prior to an election was then rescinded when that official was not

STEWART-COUSINS, HASSELL-THOMPSON, MONTGOMERY -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Government Operations AN ACT to amend the legislative law, in relation to prohibiting the withdrawal or reduction of promised funds for community projects after the departure of the original sponsoring member THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The legislative law is amended by adding a new section 13 to read as follows: S 13. COMMUNITY PROJECTS; LIMITATION ON DISTRIBUTION OF FUNDS. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, UPON THE DEPARTURE OF THE ORIGINAL SPONSORING MEMBER OF A COMMUNITY PROJECT AUTHORIZED AND DESIGNATED IN THE STATE BUDGET AS ADOPTED AND THE ELECTION OF A NEW MEMBER WHO SHALL CONTINUE TO SUPPORT SUCH PROJECT, NO MEMBER OF THE LEGISLATURE SHALL WITHDRAW OR REDUCE ANY FUNDS GRANTED FOR THE COMMUNITY PROJECT WITHOUT THE CONSENT OF THE NEW MEMBER. THIS SECTION SHALL APPLY TO ORIGINAL SPONSORING MEMBERS WHO HAVE NOT BEEN RE-ELECTED FOR THE UPCOMING TERM OF OFFICE AND SHALL PROHIBIT SUCH A MEMBER FROM DISTRIBUT- ING SUCH FUNDS PRIOR TO HIS OR HER DEPARTURE FROM OFFICE WHEN DISTRIB- UTION IS FOR A PURPOSE OTHER THAN THE FINANCING IMPLEMENTATION OF THE COMMUNITY PROJECT.
