BILL NUMBER:S3030 TITLE OF BILL: An act to amend the retirement and social security law, in relation to forfeiture of pension rights or retirement benefits upon conviction of certain crimes related to public employment PURPOSE: To amend the Social Security Law to allow for the forfeiture of pension benefits, obtained as a result of someone's status as an elected official, in the event of a felony conviction when the crime was specifically related to the official duties and responsibilities of the public office. This does not include the felony of mail fraud. SUMMARY OF PROVISIONS: Section one - Amends the retirement and social security law by adding new sections 156, 157 and 158 to new article 3-B, that establish the procedure and guidelines for forfeiture of retirement benefits for elected officials convicted of a felony. Section 156 provides definitions, such as "covered crime" which provides that any felony offense, other than mail fraud, committed by a defendant during his or her tenure as an elected official, where there was knowledge and intent on the part of the defendant to commit such crime, shall elicit initiation of a pension forfeiture proceeding.

OPPENHEIMER, MONTGOMERY -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT to amend the retirement and social security law, in relation to forfeiture of pension rights or retirement benefits upon conviction of certain crimes related to public employment THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The retirement and social security law is amended by adding a new article 3-B to read as follows: ARTICLE 3-B PENSION FORFEITURE FOR ELECTED OFFICIALS SECTION 156. DEFINITIONS. 157. PENSION FORFEITURE. 158. MISCELLANEOUS. S 156. DEFINITIONS. THE FOLLOWING WORDS AND PHRASES, AS USED IN THIS ARTICLE, SHALL HAVE THE FOLLOWING MEANINGS, UNLESS A DIFFERENT MEANING IS PLAINLY REQUIRED BY THE CONTEXT: 1. "DEFENDANT" SHALL MEAN AN ELECTED OFFICIAL AGAINST WHOM A FORFEI- TURE ACTION IS COMMENCED. 2. "COVERED CRIME" SHALL MEAN ANY FELONY OFFENSE, OTHER THAN MAIL FRAUD, COMMITTED BY A DEFENDANT DURING HIS OR HER TENURE AS AN ELECTED OFFICIAL AND WHERE THERE WAS KNOWLEDGE AND INTENT ON THE PART OF THE DEFENDANT TO COMMIT SUCH CRIME. 3. "CHIEF ADMINISTRATOR OF THE RETIREMENT SYSTEM" SHALL MEAN THE COMP- TROLLER OF THE STATE OF NEW YORK WITH RESPECT TO THE NEW YORK STATE AND LOCAL EMPLOYEES' RETIREMENT SYSTEM AND THE NEW YORK STATE AND LOCAL POLICE AND FIRE RETIREMENT SYSTEM AND THE BOARDS OF TRUSTEES WITH RESPECT TO THE OTHER PUBLIC RETIREMENT SYSTEMS AND PENSION FUNDS OF THE STATE AND THE CITY OF NEW YORK.
