BILL NUMBER:S3300

TITLE OF BILL:
An act
to amend the vehicle and traffic law, in relation to prohibiting the use
of digital license plate frames

PURPOSE OF BILL:
To eliminate a potentially dangerous distraction while driving, this
bill seeks to prohibit the use of digital license plate frames.

SUMMARY OF SPECIFIC PROVISIONS:
This legislation adds a new section 397-C to the vehicle
and traffic law.

JUSTIFICATION:
Digital license plate frames come in a variety of types and styles,
yet share several common features. Generally, these frames are
designed to display scrolling or flashing messages programmed through
a remote control. The most common design uses Light Emitting Diodes
(LEDs) to display the selected message near the license plate.

Depending on the type, the driver may be able to program their digital
frame from within the vehicle while driving. Just as with the use of
mobile phones while driving, programming digital license plate frames
while operating a motor vehicle presents a hazard to everybody on the
road. Regardless of the type, digital license plate frames distract
other motorists from driving.

Prohibiting the use of these frames will eliminate one of the many
sources of driver distraction, making our roads safer.

PRIOR LEGISLATIVE HISTORY:
2010: S.7995 - Referred to Transportation.

FISCAL IMPLICATIONS:
None to the state.

EFFECTIVE DATE:
Shall take effect on the one hundred eightieth day after it becomes a
law.
