BILL NUMBER:S4175

TITLE OF BILL:

An act
to amend the insurance law, in relation to authorizing insurance premium
reductions for private passenger vehicles retrofitted with daytime
running lamps

PURPOSE:

This bill would authorize an actuarially appropriate premium discount
on automobile insurance for vehicles that are retrofitted with
daytime running lamps, and establish a standard for retrofitted
daytime running lamps that would require prior approval by the
Superintendent of Insurance, in consultation with the Division.

SUMMARY OF PROVISIONS:

Amends Insurance Law section 2336(g) to provide that all private
passenger automobile insurers are authorized to offer an actuarially
appropriate premium discount for auto insurance coverage for motor
vehicles that are retrofitted with daytime running lamps. Further,
that the Superintendent, after consulting with the Department of
Motor Vehicles, shall promulgate by rule, qualifications and
standards for the installation of such lamps. The purpose of
establishing qualifications for the installation of retrofitted lamps
is so that this equipment is properly installed.

JUSTIFICATION:

New vehicles are equipped with daytime running lamps, installed in the
factory at the time of production. Many insurance companies offer
discounts to their customers for having daytime running lamps because
they have been demonstrated to increase visibility on the road and
thereby improve safety. This bill would require the Superintendent of
Insurance to establish a standard for older vehicles, which are not
equipped with factory-installed daytime running lamps, to retrofit
vehicles with daytime running lamps to be installed by qualified auto
body shops or car dealerships.
Establishing such a standard would ensure that these daytime running
lamps meet a
state-approved standard and would facilitate the provision of similar
discounts to owners of older vehicles.

LEGISLATIVE HISTORY:

2009-2010: A.317
2007-2008: A.5512
2005-2006: A.10758

FISCAL IMPLICATIONS:

Undetermined.

EFFECTIVE DATE:

This act shall take effect on the first of January next succeeding the
date on which it shall have become a law and shall apply to all
policies issued, renewed or amended on or after such date.

BLY, DO ENACT AS FOLLOWS:

Section 1. Subsection (g) of section 2336 of the insurance law, as

  (g) Any schedule or rating plan for non-commercial private passenger
automobile insurance shall, WITH RESPECT TO AUTOMOBILES EQUIPPED WITH
