BILL NUMBER:S4437 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to requiring motorcycles to be operated with both wheels on the roadway PURPOSE: Requires motorcycles to be operated on public highways with both wheels on the ground at all times. SUMMARY OF PROVISIONS: Section 1: Section 1251 of the vehicle and traffic law in amended to add a new subdivision (e) which states that no person shall operate a motorcycle on a public highway unless both wheels thereof remain on the roadway or ground at all times, except in a circumstance beyond the operator's control. Section 2: Enacting clause. JUSTIFICATION: This legislation will allow law enforcement officers to cite motorcyclists who perform wheelies, riding on the rear wheel only, or "stoppies", riding on the front wheel only, on public highways. There is currently no provision in the vehicle and traffic law that prohibits this type of dangerous activity.

LARKIN -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to requiring motorcycles to be operated with both wheels on the roadway THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1251 of the vehicle and traffic law is amended by adding a new subdivision (e) to read as follows: (E) NO PERSON SHALL OPERATE A MOTORCYCLE ON A PUBLIC HIGHWAY UNLESS BOTH WHEELS THEREOF REMAIN ON THE ROADWAY OR GROUND AT ALL TIMES, EXCEPT IN A CIRCUMSTANCE BEYOND THE OPERATOR'S CONTROL. S 2. This act shall take effect on the first of September next succeeding the date on which it shall have become a law.
