BILL NUMBER:S4967

TITLE OF BILL:
An act
to amend the environmental conservation law, in relation to continuing
the authority of the department of environmental conservation to adopt
regulations for hunting in the northern zone

PURPOSE:
To extend the Department of Environmental Conservation's (DEC)
regulatory authority to manage deer hunting in the Northern Zone.

SUMMARY OF PROVISIONS:
This bill would extend DEC's authority to establish, by regulation,
management measures for muzzle-loading firearm big game season in the
Northern Zone until October 1, 2015.

JUSTIFICATION:
Authority to set regulations by order provides a timely administrative
process that optimizes the effectiveness of harvest management
techniques. This legislation would extend DEC's authority to set, by
regulation, the length and timing of the early and late Northern Zone
muzzle-loading seasons, and to specify the taking of deer of either
sex, antlerless deer only, legal bucks only, or any combination
thereof. This flexibility allows DEC to set muzzle-loading seasons to
promote recreational hunting and herd control most effectively. For
example, in areas with large deer populations and a high potential
for conflict with bow hunters, a late muzzle-loading firearm season
would provide an additional opportunity for taking of deer while
minimizing conflicts with other hunters. In the Adirondacks, concern
about lower deer numbers might result in a short, early
muzzle-loading season.

LEGISLATIVE HISTORY:
Last extended by Chapter 140 of the Laws of 2007.

FISCAL IMPLICATIONS:
None to the State.

EFFECTIVE DATE:
This act shall take effect immediately.

AN ACT to amend the environmental conservation law, in relation to
continuing the authority of the department of environmental conserva-
tion to adopt regulations for hunting in the northern zone

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

Section 1. Paragraph c of subdivision 8 of section 11-0907 of the
environmental conservation law, as amended by chapter 140 of the laws of
2007, is amended to read as follows:
  c. Until October first, two thousand [eleven] FIFTEEN, such special
season for the Northern Zone or any portion thereof may by regulation be
for up to a fourteen-day period preceding the regular open season for
deer stated in column two of the table set forth in subdivision 2 of
this section or may be for up to a fourteen-day period following such
open season or any combination thereof, provided that a maximum of
sixteen days is not exceeded for any open area. Regulations establishing
such Northern Zone muzzle-loading firearm big game season may specify
the taking of deer of either sex, antlerless deer only, legal bucks
only, or any combination thereof, and may require that persons partic-
ipating in the Northern Zone muzzle-loading firearm big game season
obtain a special permit from the department. When establishing these
regulations, the department must consider the condition of the herd and
communities', property owners', hunters' and other relevant interests.
S 2. This act shall take effect immediately.
