TITLE OF BILL:
An act
to amend the public authorities law, in relation to prohibiting bonuses
for employees of public authorities

PURPOSE OR GENERAL IDEA OF BILL:
The purpose of the bill is to remove the ability of public authorities
to pay bonuses.

SUMMARY OF SPECIFIC PROVISIONS:
Section One adds a section 2854 of the public authorities law
that will now prohibit the payment of bonuses.

Section Two adds the effective date.

JUSTIFICATION:
Recent newspaper articles have cited the practice by the New York
Power Authority and other state authorities of paying bonuses on top
of lucrative salaries and other perks. In a time of fiscal crisis
State Authorities should not be authorizing bonuses.

AN  ACT  to amend the public authorities law, in relation to prohibiting
  bonuses for employees of public authorities

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  public  authorities  law  is amended by adding a new
section 2854 to read as follows:
  S  2854.  PROHIBITION  ON  PAYMENT  OF  BONUSES.  NOTWITHSTANDING  ANY
PROVISION  OF  LAW, COMPENSATION PAID OR OTHERWISE PROVIDED TO EMPLOYEES
OF STATE AUTHORITIES SHALL BE LIMITED TO SALARY AND BENEFITS  COMPARABLE
TO  THOSE BENEFITS PROVIDED TO CIVIL SERVICE EMPLOYEES, AND, IF APPLICA-
BLE, REIMBURSEMENT OF EXPENSES. NO BONUS OF ANY NATURE SHALL BE PAID  TO
ANY EMPLOYEE OR BOARD MEMBER OF A STATE AUTHORITY PROVIDED THAT ANY SUCH
PROHIBITION SHALL ONLY APPLY TO EMPLOYEES NOT COVERED UNDER A NEGOTIATED
CONTRACT.
  S 2. This act shall take effect immediately.

PROVISION OF LAW, IN NO  EVENT  SHALL  EMPLOYEES  OF  STATE  AUTHORITIES
RECEIVE  ADDITIONAL  COMPENSATION  AS  A  REWARD  FOR  SERVICES  ALREADY
RENDERED AND FULLY COMPENSATED, SUCH  AS  A  BONUS  OR  RETROACTIVE  PAY
INCREASE;  PROVIDED,  HOWEVER,  THAT  NOTHING  IN  THIS SECTION SHALL BE
DEEMED TO PREVENT A STATE AUTHORITY  FROM  PAYING  AN  INCENTIVE  TO  AN
EMPLOYEE  IN  ACCORDANCE WITH A WRITTEN INCENTIVE PROGRAM ADOPTED BY THE
BOARD OF THE STATE AUTHORITY. NO INCENTIVE SHALL BE PAID UNLESS A  WRIT-
TEN  AGREEMENT  SETTING  FORTH A SPECIFIC PERFORMANCE GOAL OR GOALS THAT
MUST BE ACHIEVED TO EARN THE INCENTIVE OR INCENTIVES IS EXECUTED BY  THE
EMPLOYEE  BEFORE  PERFORMANCE TO ACHIEVE THE GOAL OR GOALS IS BEGUN; AND
THE INCENTIVE SHALL NOT BE PAID  UNLESS  WRITTEN  DOCUMENTATION  OF  THE
ACHIEVEMENT  OF  SUCH  PERFORMANCE  GOAL OR GOALS HAS BEEN PLACED IN THE
EMPLOYEE'S PERSONNEL FILE.
