BILL NUMBER:S5607 REVISED 06/08/11 TITLE OF BILL: An act to legalize, validate, ratify and confirm certain transportation contracts of the Hamburg central school district PURPOSE: Legalizes, validates, ratifies, and confirms certain transportation contracts of Hamburg Central School District. SUMMARY OF PROVISIONS: This bill rectifies submission errors made by Hamburg Central School district when filing transportation agreements from the 2005-06 school year. JUSTIFICATION: The Hamburg Central School District made an error in submitting transportation contracts for the 2005-2006 school year, and as a result, the State Department of Education did not approve them. In order for Hamburg Central to receive the correct amount of state transportation aid these past contract numbers must now be validated through special legislation. Failure to receive reimbursement of the transportation contract costs would create undue fiscal hardship to the school district and its students.

KENNEDY -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to legalize, validate, ratify and confirm certain transportation contracts of the Hamburg central school district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. All the acts done and proceedings heretofore had and taken or caused to be had and taken by the Hamburg central school district and by all officers, employees or agents of such school district relating to or in connection with certain transportation contracts E000042, E010526, E010527, E010528, E010529, E010530, E010531, E010532, E010533, E010534, E010535, E010537, E010539, and E610793 of the 2005-2006 school year with various contractors, and all acts incidental thereto are hereby legal- ized, validated, ratified and confirmed, notwithstanding any failure to comply with the contract award, approvals and filing provisions of the education law, general municipal law or any other law or any other stat- utory authority, rule or regulation, other than those filing provisions defined in paragraph a of subdivision 5 of section 3604 of the education law, in relation to any omission, error, defect, irregularity or ille- gality in such proceeding had and taken. S 2. The education department is hereby directed to consider the aforementioned contracts for transportation aid as valid and proper obligations of the Hamburg central school district. S 3.
