Introduced by Sens. KLEIN, PARKER, RANZENHOFER -- read twice and ordered
printed, and when printed to be committed to the Committee on Health

AN ACT to amend the public health law, in relation to authorizing the
commissioner of health, in consultation with the superintendent of
financial services, to develop uniform plan-provider contracts and the
provisions thereof; and providing for the repeal of such provisions
  upon the expiration thereof

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

Section 1. Legislative intent. The legislature finds that the public
would benefit greatly if the commissioner of health, in consultation
with the superintendent of financial services, were to develop uniform
plan-provider contracts (UPPCs) and the provisions thereof, not includ-
ing rate sheets, through a process that requires support from represen-
tatives of health plans, health care providers, consumers and employers,
and to adopt and require the use of such UPPCs and provisions thereof by
health plans and health care providers when contracting for the
provision of health care services to fee-for-service plan enrollees.
The legislature finds that the use of UPPCs and such provisions there-
of would: (a) significantly reduce expenditures by health plans and
health care providers in the drafting, review, negotiation and implemen-
tation of plan-provider contracts; (b) reduce expenditures by the state
and municipalities in the contract-by-contract review and approval of
such agreements; (c) reduce or eliminate unclear provisions, unfair
provisions and non-compliant provisions in plan-provider contracts; (d)
make it practical for provider clinical and administrative staff to
learn and follow requirements in plan-provider contracts; (e) reduce
interpretive disputes; and (f) help plans meet their medical loss ratio
requirements under the federal health care reform law.
S 2. The public health law is amended by adding a new section 4406-f
to read as follows:
S 4406-F. UNIFORM PLAN-PROVIDER CONTRACTS. 1. DEFINITIONS. AS USED IN
THIS SECTION:
  (A) "CONTRACT PROVISION" MEANS ANY INDIVIDUAL PROVISION OF A UPPC.

EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
[ ] is old law to be omitted.
