BILL NUMBER:S6983

TITLE OF BILL:
An act to repeal title 8 of article 15-B of the general municipal law
relating to the Mount Kisco urban renewal agency; and to transfer any
books, records and remaining rights of the dissolved authority to the
village of the Mount Kisco

PURPOSE:
This legislation does away with the Mount Kisco urban renewal agency;
repealer.

SUMMARY OF PROVISIONS:
Section One - Repeals title 8 of article 15-B of the general municipal
law.

Section Two - Transfers any existing records, property, rights, titles
and interest of the Mount Kisco urban renewal agency to the village of
Mount Kisco.

Section Three - States the effective date.

JUSTIFICATION:
This legislation was requested by the Town/Village of Mount Kisco, in
an effort to streamline economic development within the village.

The Mount Kisco Urban Renewal Agency is a moribund public authority
which has long since achieved its purpose in the 1570s. This bill
dissolves that agency, which is no longer actively engaged in the
public purpose for which it was established.

Under existing law, the Village Board of Trustees functions as the
Urban Renewal Agency, thus adding an additional, unnecessary layer of
government for sitting projects. Once a project has Planning Board
Approval, the Village Board must take additional action on it.

This additional layer of approval is unnecessary, and this bill is
required to repeal the statutory authorization of an authority which
is now defunct.

The Mount Kisco Urban Renewal has been determined inactive by the New
York State Authorities Budget Office, the Department of Economic
Development, the Office of the State Comptroller, and the Commission
on Public Authority Reform, based on consultation with the
Town/Village of Mount Kisco.

Although the authority no longer functions, its authorization
continues in State Law. It has no outstanding debt or other
obligations. This bill would repeal various sections of the general
municipal law to formally dissolve the authority, and update state law
to reflect the fact that this authority, has, as a practical matter,
ceased to exist, thus promoting the State's interest in curbing the
proliferation of unnecessary authorities.

EFFECTIVE DATE:
This act shall take effect on the sixtieth day.

AN ACT to repeal title 8 of article 15-B of the  general  municipal  law
  relating  to the Mount Kisco urban renewal agency; and to transfer any
  books, records and remaining rights of the dissolved authority to  the
  village of Mount Kisco

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Title 8 of article 15-B of the general  municipal  law,  as
added by chapter 266 of the laws of 1964, is REPEALED.
  S  2.  Notwithstanding any other provision of law to the contrary, any
existing records, property, rights, titles and  interest  of  the  Mount
Kisco urban renewal agency shall vest in and be possessed by the village
of Mount Kisco and its successors or assigns.
  S  3.  This  act  shall take effect on the sixtieth day after it shall
have become a law.
