BILL NUMBER:S7170

TITLE OF BILL:
An act
authorizing the transfer of certain state lands in the town of
Orangetown

PURPOSE:
To facilitate the acquisition of certain state lands located within
the town of Orangetown by the town for the purpose of ensuring that
such lands are developed in a manner consistent with the
comprehensive plan of the town.

SUMMARY OF PROVISIONS:
Section 1 grants the town of Orangetown a right of first negotiation
for all state lands located within the boundaries set forth in
section three of the act. The right will exist for until December 31,
2020. The commissioner of the office of general services is empowered
to negotiate and accept any offer as he or she deems proper. The
commissioner is further authorized to extend the period of
negotiation for an additional period.

Section 2 directs the commissioner of general services to provide the
town of Orange town with a written description of state land within
the bounds set forth in section three of the bill.

Section 3 establishes the boundaries of the area in the town of
Orangetown where state lands subject to the right of first
negotiation are located. The bounds capture the land associated with
the Rockland Psychiatric Center.

Section 4 reiterates the prohibition of certain land sales by the
state constitution.

Section 5 provides that this act shall not affect any person's
contract rights or right to sue.

Section 6 provides that land transactions authorized by this act are
subject to accurate surveys and any existing covenants, conditions,
restrictions, easements and rights-of-way.

Section 7 permits the town to waive any right conferred by this act.

JUSTIFICATION:
The Town of Orangetown has requested this legislation in order to
develop state lands at or near the Rockland psychiatric Center site.
This will benefit the community by helping to stimulate the local
economy by facilitating the development of high technology industries
and by developing low-density residential neighborhoods suitable for
the local senior citizen population.

AN ACT authorizing the transfer of certain state lands in  the  town  of
  Orangetown

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. (a) Notwithstanding any other law to  the  contrary,  state
lands,  including  any buildings and improvements thereon erected, situ-
ate, lying and being within the bounds set forth  in  section  three  of
this act shall be made available by the commissioner of general services
for    acquisition  only  by the town of Orangetown, upon such terms and
conditions as such commissioner may deem proper, including consideration
as he or she may fix and determine,  for  a  period  commencing  on  the
effective  date of this act and ending on December 31, 2020. During such
period the town may tender an offer to the state for the acquisition  of
such  lands,  including  any buildings and improvements thereon erected,
which such commissioner may accept on behalf of the state at  any  time,
provided  that the town has not notified such commissioner in writing of
the revocation of such offer.
  (b) Nothing in this section shall be construed to require such commis-
sioner to sell any state lands.
  (c) Such commissioner may extend the  period  for  acquisition  estab-
lished  by  this  section  for  a  period  that  he or she deems proper,
provided that written notice of such extension is delivered to the  town
prior to the expiration of the period subject to the extension.
  S  2.  (a)  Within  thirty days of the effective date of this act, the
commissioner of general services shall provide to the town of Orangetown
a written description of all whole parcels of state lands located within
the bounds set forth in section three of this act.
  (b) Within the thirty days following the closing of any sale,  convey-
ance  or  transfer  by  the  state of any state lands located within the
bounds set forth in section three  of  this  act,  the  commissioner  of
general  services  shall  provide  to  the  town of Orangetown a written

description of all remaining whole parcels of state lands located within
the bounds set forth in section three of this act.
  (c)  Written descriptions of land required by this section shall be of
such particularity as such commissioner deems appropriate, provided that
such descriptions shall adequately identify  any  such  available  whole
parcels of state lands for the purpose of procuring a land sale, convey-
ance or transfer.
  (d)  The effect of the provisions of this section shall continue until
December 31, 2020.
  S 3. The lands,  with  buildings  and  improvements  thereon  erected,
subject  to  the  provisions of this act are located within that part of
the town of Orangetown in the county  of  Rockland  bounded  by  a  line
described as follows:
  BEGINNING  at the intersection of the northern line of county of Rock-
land route number twenty and the western line of  the  Palisades  Inter-
state Parkway; RUNNING THENCE westerly along the northern line of county
of Rockland route number twenty to the intersection of the northern line
of county of Rockland route number twenty and the eastern line of county
of  Rockland route number twenty-three; THENCE northerly along the east-
ern line of county of Rockland route number twenty-three to  the  inter-
section  of  the eastern line of county of Rockland route number twenty-
three and the southern line of Convent Road; THENCE easterly  along  the
southern  line  of Convent Road to the intersection of the southern line
of Convent Road and the western line of the Palisades  Interstate  Park-
way; THENCE southerly along the western line of the Palisades Interstate
Parkway to the point of BEGINNING.
  S  4.  No  state  lands,  the sale, conveyance or transfer of which is
prohibited by the constitution, shall be affected by the  provisions  of
this act.
  S 5. No existing remedy or executed contract, lease or agreement shall
be impaired by this act.
  S  6.  Any  transaction  for  the sale, conveyance or transfer of land
authorized by this act is subject to any statement of facts an  accurate
survey  may  show  pertaining to any such land and is further subject to
any covenants, conditions, restrictions, easements and rights-of-way, if
any, contained in instruments of record affecting said premises  so  far
as the same may now be in force and effect.
  S  7.  The  town  of  Orangetown  may  affirmatively  waive  any right
conferred upon it by this act upon a majority vote  of  its  town  board
approving a resolution waiving any such right.
  S 8. This act shall take effect immediately.

the Rockland Psychiatric Center.

contract rights or right to sue.

Section 5: provides that land transactions authorized by this act are
subject to accurate surveys and any existing covenants, conditions,
restrictions, easements and rights-of-way.

JUSTIFICATION:
The Town of Orangetown has requested this legislation
in order to develop state lands at or near the Rockland Psychiatric
Center site. This will benefit the community by helping to stimulate
the local economy by facilitating the development of the property
with uses that are consistent with the town's comprehensive plan,
such as high technology industries and by developing low-density
residential neighborhoods suitable for the local senior citizen
population.

Orangetown for fair market value, and upon  such  additional  terms  and
conditions  as  the  commissioner  may  deem proper, for a period of two
years following the effective date of this act.
  S 2. (a) Within sixty days of the effective  date  of  this  act,  the
commissioner of general services shall provide to the town of Orangetown
an  accurate  survey  of all whole parcels of state lands located within
the bounds set forth in section three of this act that were declared  to
be no longer necessary or useful to the purposes of the office of mental
health by the commissioner of such agency.
  (b)  Within  the sixty days following the closing of any sale, convey-
ance or transfer by the state of any  state  lands  located  within  the
bounds  set  forth  in  section  three  of this act, the commissioner of
general services shall provide to  the  town  of  Orangetown  a  written
description of all remaining whole parcels of state lands located within
the  bounds  set  forth in section three of this act that are to be made
available to the town for purchase pursuant to this act.
  (c) Written descriptions of land required by this section shall be  of
such  particularity as the commissioner of general services deems appro-
priate, provided that such descriptions shall  adequately  identify  any
such available whole parcels of state lands for the purpose of procuring
a land sale, conveyance or transfer.
