TITLE OF BILL:
An act
to authorize the towns of Lodi and Ovid in Seneca
county to elect a single town justice to preside in the town courts of
such towns

PURPOSE:
This bill would allow the Towns of Lodi and Ovid in Seneca county to
elect one Town Justice to preside in the town courts of such towns.

SUMMARY OF PROVISIONS:
Amends the Uniform Justice Court Act authorizing the towns of Lodi and
Ovid in Seneca county, to elect a single town justice to preside in
the town courts of such towns and provides for an immediate effective
date.

JUSTIFICATION:
The Towns of Lodi and Ovid are contiguously located in Seneca county.
In an effort to consolidate services, the towns have requested that a
single town justice preside over both town courts.

In recent years, the need for two town justices in these adjacent
towns seems unnecessary. Recently the position of town Justice for
Town of Ovid has become vacant and the two towns see this as an
opportunity to consolidate services and reduce expenditures. Upon a
temporary appointment by the Fifth Judicial District Administrative
Judge, the position of Town Justice in the Town of Ovid had been
filled by the Honorable Louis VanCleef, Town of Lodi Justice. So far
this arrangement has been beneficial to both towns.

Both Towns support consolidating to use one Justice for both towns, and
for the combined Justice to hold court in the town courts of such
towns.

AN ACT to authorize the towns of Lodi and Ovid in Seneca county to elect
  a single town justice to preside in the town courts of such towns

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Pursuant to section 106-b of the uniform justice court act,
the towns of Lodi and Ovid of Seneca county have conducted and completed
a  study,  each town having adopted a joint resolution providing for the
study, conducted a public hearing upon the findings of  the  study,  and
adopted  a  joint resolution adopting such plan providing for the aboli-
tion of existing town justice positions in the towns of  Lodi  and  Ovid
and  providing  for  the election of a single town justice to preside in
the town courts of such towns.   The town justice  elected  pursuant  to
this plan shall preside in the towns of Lodi and Ovid following the next
general  election  in  such towns and shall preside for the year term as
elected.
  S 2. This act shall take effect immediately.
