AN ACT to amend the public health law, in relation to prohibiting the
sale of electronic cigarettes
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 1399-aa of the public health law is amended by
adding a new subdivision 13 to read as follows:
13. "ELECTRONIC CIGARETTE" MEANS A BATTERY-OPERATED DEVICE THAT
CONTAINS CARTRIDGES FILLED WITH A COMBINATION OF NICOTINE, FLAVOR AND
CHEMICALS THAT ARE TURNED INTO VAPOR WHICH IS INHALED BY THE USER.
S 2. Section 1399-ll of the public health law, as added by chapter 518
of the laws of 2000, is redesignated section 1399-ll-1 and a new section
1399-ll-2 is added to read as follows:
S 1399-LL-2. SALE OF ELECTRONIC CIGARETTES PROHIBITED. NO PERSON SHALL
SELL OR OFFER FOR SALE ANY ELECTRONIC CIGARETTE.
S 3. This act shall take effect on the first of January next succeed-
ing the date on which it shall have become a law.
