BILL NUMBER:S7668 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to increasing fines for throwing refuse on highways and adjacent lands PURPOSE: To create a greater deterrent to littering on New York highways and adjacent lands. SUMMARY OF PROVISIONS: Section one amends the vehicle and traffic law to increase the current fine of $350 to $700 for the first offense and from $700 to $1,400 for the second offense. JUSTIFICATION: New York's roadways continue to become littered despite the fines currently under existing law. Increasing these fines will act as a greater deterrent to these acts. LEGISLATIVE HISTORY: New bill. FISCAL IMPLICATIONS: None.

DeFRANCISCO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the vehicle and traffic law, in relation to increasing fines for throwing refuse on highways and adjacent lands THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision (c) of section 1220 of the vehicle and traffic law, as amended by chapter 418 of the laws of 2007, is amended to read as follows: (c) A violation of the provisions of subdivision (a) of this section shall be punishable by a fine not to exceed [three] SEVEN hundred fifty dollars and/or a requirement to perform services for a public or not- for-profit corporation, association, institution or agency not to exceed ten hours and for any second or subsequent violation by a fine not to exceed [seven] ONE THOUSAND FOUR hundred dollars and/or a requirement to perform services for a public or not-for-profit corporation, associ- ation, institution or agency not to exceed fifteen hours. S 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
