AN ACT to authorize the city of Albany to discontinue the use of certain
lands as park lands
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subject to the provisions of this act, but notwithstanding
any provision of law to the contrary, the city of Albany, located in the
county of Albany, is hereby authorized, acting by and through its common
council and upon such terms and conditions as determined by such common
council, to discontinue the use as park lands the lands more particular-
ly described in section two of this act and to transfer such lands which
are no longer needed for park purposes for use in connection with the
development of property for independent senior garden apartments.
S 2. The lands authorized by this act to be discontinued as parklands
are as follows:
All that tract, piece or parcel of land situate, lying and being in
the City of Albany, County of Albany, State of New York, more partic-
ularly described as follows:
Beginning at a point on the southeasterly side of South Allen Street
60 feet northeasterly from the corner of South Allen Street and Dale
Place and running thence northeasterly along said southeasterly side of
South Allen Street a distance of 390 feet to a point, thence southeast-
erly along the southerly line of lot 252 as shown on map of Allen Street
Terrace referenced below, 100 feet, running thence northeasterly on a
line parallel to South Allen Street 60 feet to the south line of lot 165
on said map, thence southeasterly 98 feet to the northwest side of
Onderdonk Avenue, thence running southwesterly along the northwesterly
side of Onderdonk Avenue 510 feet to the northerly line of Dale Place,
running thence northwesterly along the said northerly line of Dale Place

98 feet, thence northeasterly on a line parallel to South Allen Street
60 feet, thence northwesterly 100 feet to the southeasterly side of
South Allen Street, the point and place of beginning.
Said parcels being lots 166 to 182 on Onderdonk Avenue and Lots 239 to
251 fronting on South Allen Street as shown on map or plan of Allen
Street Terrace, made by A.L. Eliot, C.E. dated March 8, 1911 and filed
in the Albany County Clerk's Office in Book 25 as Map 750, said lands to
be removed from park purposes.
S 3. The authorization provided in section one of this act shall be
effective only upon the condition that on or before the alienation and
conveyance of lands described in section two of this act, the city of
Albany shall dedicate new city park lands of equal or greater fair
market value to the lands being alienated. The additional park lands to
be dedicated for park and recreational purposes being bounded and
described as follows:
All that tract, piece or parcel of land, situate, lying and being in
the Former Eighth and Ninth Wards of the City of Albany, County of Alba-
ny and State of New York and being more particularly bounded and
described as follows:
Beginning at a point in the northeasterly line of Colonie Street, said
point being the intersection of the division line between Disposition
Parcel No. 4 on the southeast and Disposition Parcel No. 10, herein
intended to be described, on the northwest with the northeasterly line
of Colonie Street, said point also being distant 27.10 feet southeaster-
ly measured along the northeasterly line of Colonie Street from its
intersection with the southeasterly line of a parcel of land known as
185 Colonie Street as shown on Official Record Maps of the City of Alba-
ny filed in the office of the City Engineer; thence from said point or
place of beginning, in a northeasterly direction and along said division
line between Disposition Parcel No. 4 on the southeast and Disposition
Parcel No. 10 herein being described on the northwest, North 47 deg. 28'
49" East for a distance of 268.10 feet to a point in the southwesterly
line of Manning Boulevard, said point being the intersection of said
division line between Disposition Parcel No. 4 and Disposition Parcel
No. 10 with the southwesterly line of Manning Boulevard; thence in a
northwesterly direction and along the southwesterly line of Manning
Boulevard, North 42 deg. 31' 11" West for a distance of 230.61 feet to a
point; thence continuing in a northwesterly direction and along the
southwesterly line of Manning Boulevard and along the arc of a curve to
the right having a central angle of 21 deg. 49' 43", a radius of 925
feet, for a distance of 352.41 feet to a point; thence continuing in a
northwesterly direction and along the southwesterly line of Manning
Boulevard; thence in a general westerly direction and along the arc of a
curve to the left having a central angle of 100 deg. 47' 29", a radius
of 20 feet, for a distance of 35.16 feet to a point in the southeasterly
line of Lark Street; thence in a southwesterly direction and along the
southeasterly line of Lark Street and along a portion of an arc of a
curve to the left, said portion of arc having a central angle of 11 deg
02' 14", a radius of 1573.25 feet, for a distance of 303.07 feet to a
point; thence continuing in a southwesterly direction and along the
southeasterly line of Lark Street, South 47 deg 28' 49" West for a
distance of 73.27 feet to a point in the southeasterly line of Lark
Street; said point being the intersection of the southeasterly line of
Lark Street with the northwesterly prolongation of the rear or
northeasterly line of a parcel of land known as number 295 Colonie
Street, thence in a southeasterly direction and along the rear or

northeasterly line of said parcel of land known as number 295 Colonie
Street, South 42 deg. 31' 11" East for a distance of 312.15 feet to a
point, said point being the intersection of the northeasterly prolonga-
tion of the division line between number 295 Colonie Street on the
northwest and number 255 Colonie Street on the southeast with the rear
or northeasterly line of number 295 Colonie Street; thence in a south-
westerly direction and along said northeasterly prolongation of the
division line between number 295 Colonie Street and number 255 Colonie
Street, South 47 deg. 28' 49" West for a distance of 90.00 feet to a
point, said point being distant 100.00 feet northeasterly measured along
said division line between number 295 Colonie Street and Number 255
Colonie Street from its intersection with the northeasterly line of
Colonie Street, said point also being the intersection of the division
line between number 295 Colonie Street and number 255 Colonie Street
with the rear or northeasterly line of numbers 255 Colonie Street
through number 233 Colonie Street; thence in a southeasterly direction
and along 233 Colonie Street, South 42 deg. 31' 11" East for a distance
of 374.50 feet to a point, said point being the intersection of said
rear or northeasterly line of numbers 255 Colonie Street through number
233 Colonie Street with the division line between number 233 Colonie
Street with the northwest side of number 231 Colonie Street on the
southeast; thence in a northeasterly direction and along the northeast-
erly prolongation of said division line between number 233 Colonie
Street and number 231 Colonie Street, North 47 deg 28" 49" East for a
distance of 25.00 feet to a point, said point being the intersection of
the northeasterly prolongation of said division line between number 233
Colonie Street and number 231 Colonie Street with the rear or northeast-
erly line of numbers 231 Colonie Street through number 191 Colonie
Street; thence in a southeasterly direction and along the rear or
northeasterly line of numbers 231 Colonie Street through number 191

to a point, said point being the intersection of said rear or northeast-

on the southeast; thence in a southwesterly direction and along the
northeasterly prolongation of said division line between number 191

point, said point being the intersection of said division line between
number 191 Colonie Street and number 189 Colonie Street with the rear or
northeasterly line of numbers 189 Colonie Street through number 185
Colonie Street; thence in a southeasterly direction and along the rear
or northeasterly line of numbers 189 through 185 Colonie Street, South
42 deg. 31' 11" East for a distance of 61.69 feet to a point, said point
being the intersection of said rear or northeasterly line of numbers 189
Colonie Street through 185 Colonie Street; thence in a southwesterly
direction and along the southeasterly line of number 185 Colonie Street,
South 47 deg. 28' 49" West for a distance of 100.00 feet to a point in
the northeasterly line of Colonie Street, said point being the inter-
section of said southeasterly line of number 185 Colonie Street with the
northeasterly line of Colonie Street; thence in a southeasterly direc-
tion and along the northeasterly line of Colonie Street, South 42 deg.
31' 11" East for a distance of 27.10 feet to the point or place of
beginning, containing 308,614.263± sq. ft. or 7.0848 acres more or less,
said lands to be dedicated for park purposes.
