Establishes a special fund to be known as the defense of the elderly fund to be made available to the division of criminal justice services for the creation of public information and promotional materials in support of state and local, and public and private initiatives that enhance law enforcement and crime prevention services that respond to the needs and concerns of the elderly.

COOK, McENENY, MILLMAN, PHEFFER -- read once and referred to the Committee on Aging AN ACT to amend the state finance law, in relation to the establishment of a special fund to be known as the defense of the elderly fund, and the establishment of a payroll deduction plan for contributions by state employees to such fund THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The state finance law is amended by adding a new section 92-gg to read as follows: S 92-GG. DEFENSE OF THE ELDERLY FUND. 1. A SPECIAL FUND TO BE KNOWN AS THE "DEFENSE OF THE ELDERLY FUND" IS HEREBY ESTABLISHED IN THE CUSTODY OF THE STATE COMPTROLLER AND THE COMMISSIONER OF TAXATION AND FINANCE. 2. THE FUND SHALL CONSIST OF ALL MONIES TRANSFERRED TO SUCH FUND PURSUANT TO LAW, ALL MONIES REQUIRED BY ANY PROVISION OF LAW TO BE PAID INTO OR CREDITED TO THE FUND, AND ANY INTEREST EARNINGS THAT MAY ACCRUE FROM THE INVESTMENT OF MONIES IN THE FUND. NOTHING CONTAINED HEREIN SHALL PREVENT THE STATE FROM RECEIVING GRANTS, GIFTS OR BEQUESTS FOR THE PURPOSES OF THE FUND AS DEFINED IN THIS SECTION AND DEPOSITING THEM IN THE FUND ACCORDING TO LAW. NOR SHALL ANYTHING CONTAINED HEREIN PRECLUDE THE STATE FROM ENTERING INTO COMMERCIAL AGREEMENTS WITH PRIVATE INDIVID- UALS AND PRIVATE SECTOR ENTITIES WHO WOULD MAKE SUCH GRANTS, GIFTS AND BEQUESTS IN CONSIDERATION OF RECEIVING RECOGNITION FOR THEIR SUPPORT OF THE PURPOSES OF THE FUND. 3. MONIES OF THE FUND, WHEN ALLOCATED, SHALL BE AVAILABLE TO THE DIVI- SION OF CRIMINAL JUSTICE SERVICES FOR THE CREATION OF PUBLIC INFORMATION AND PROMOTIONAL MATERIALS IN SUPPORT OF STATE AND LOCAL, AND PUBLIC AND PRIVATE INITIATIVES THAT ENHANCE LAW ENFORCEMENT AND CRIME PREVENTION SERVICES THAT RESPOND TO THE NEEDS AND CONCERNS OF THE ELDERLY.
