S T A T E O F N E W Y O R K ________________________________________________________________________ 3341 2011-2012 Regular Sessions I N A S S E M B L Y January 24, 2011 ___________ Introduced by M. of A. MILLMAN -- read once and referred to the Commit- tee on Cities AN ACT to amend the administrative code of the city of New York, in relation to providing that a certain portion of the sidewalk adjacent to the licensed premises of certain second-hand articles dealers is considered to be part of the licensed premises THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision a of section 20-268 of the administrative code of the city of New York, as amended by local law number 39 of the city of New York for the year 2006, is amended to read as follows: a. (1) It shall be unlawful for any dealer in second-hand articles to carry on his or her business at any place other than the one designated in such license. (2) FOR PURPOSES OF THIS SUBCHAPTER, A PLACE OF BUSINESS DESIGNATED IN A LICENSE SHALL INCLUDE THAT PORTION OF THE SIDEWALK IMMEDIATELY ADJA- CENT TO THE LICENSED PREMISES FOR THE LENGTH OF STOREFRONT OF THE LICENSED PREMISES AND FOR A WIDTH OF THREE FEET FROM THE FRONT OF THE LICENSED PREMISES, PROVIDED THE SIDEWALK IS A MINIMUM OF SIX FEET WIDE FROM THE FRONT OF THE LICENSED PREMISES TO THE CURB OR STREET. THE PROVISIONS OF THIS PARAGRAPH SHALL NOT APPLY TO DEALERS OF AUTOMOBILES, MOTOR AND OTHER VEHICLES. S 2. This act shall take effect immediately.
