AN ACT to amend the education law, in relation to expenses incurred  for
  school bus safety improvements

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The education law is amended by adding a new section 3625-a
to read as follows:
  S 3625-A. SCHOOL BUS SAFETY IMPROVEMENTS.  ANY  CONTRACT  OR  CONTRACT
RENEWAL FOR THE TRANSPORTATION OF SCHOOL CHILDREN AUTHORIZED PURSUANT TO
SECTION  THIRTY-SIX  HUNDRED  TWENTY-FIVE  OF  THIS PART SHALL INCLUDE A
PROVISION WHEREBY THE CONTRACTOR PROVIDING PUPIL TRANSPORTATION SERVICES
SHALL BE HELD HARMLESS FOR EXPENSES INCURRED BY SUCH  CONTRACTOR  DURING
THE COURSE OF THE CONTRACT OR CONTRACT RENEWAL AS A RESULT OF SCHOOL BUS
SAFETY  IMPROVEMENTS MANDATED BY LAW, RULE OR REGULATION AND NOT REASON-
ABLY FORESEEN AT THE TIME THE  CONTRACT  WAS  EXECUTED.  THE  DEPARTMENT
SHALL  BE  RESPONSIBLE  FOR  SUCH ADDITIONAL EXPENSES. THE DEPARTMENT OF
TRANSPORTATION SHALL ESTABLISH A PROCEDURE TO REVIEW THE  REASONABLENESS
AND  LEGITIMACY  OF CLAIMS MADE BY THE CONTRACTOR PROVIDING PUPIL TRANS-
PORTATION SERVICES TO THE DEPARTMENT FOR SUCH ADDITIONAL EXPENSES.
  S 2. This act shall take effect on the first of July  next  succeeding
the  date  on  which  it  shall have become a law and shall apply to any
contract executed on or after such date.
