AN ACT to amend the executive law, in relation to the placement  of  sex
  offenders into certain facilities

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The executive law is amended by adding a new section 250 to
read as follows:
  S 250. PLACEMENT OF HIGH RISK (LEVEL 3)  SEX  OFFENDERS.  NEITHER  THE
DIVISION  OF PROBATION AND CORRECTIONAL ALTERNATIVES, NOR THE DEPARTMENT
OF CORRECTIONAL SERVICES, SHALL PLACE A HIGH RISK (LEVEL 3) SEX OFFENDER
AS DEFINED IN THE CORRECTION LAW IN ANY  STATE  OPERATED  FACILITY  THAT
OFFERS  INPATIENT  SERVICES TO DEVELOPMENTALLY DISABLED CHILDREN WHO ARE
UNDER THE AGE OF EIGHTEEN.
  S 2. This act shall take effect immediately.
