Prohibits any charitable, civic, eleemosynary or other similar organization or association from discriminating against persons who are performing or are seeking to perform volunteer services on the basis of race, creed, color, national origin, sex, age, disability or marital status.

RIVERA, TOWNS, WRIGHT, ZEBROWSKI -- read once and referred to the Committee on Consumer Affairs and Protection AN ACT to amend the executive law, in relation to prohibiting discrimi- nation against persons who perform volunteer services THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 292 of the executive law is amended by adding a new subdivision 35 to read as follows: 35. THE TERM "VOLUNTEER SERVICES" MEANS SERVICES PERFORMED WITHOUT REMUNERATION FOR ANY ORGANIZATION, ASSOCIATION, SCHOOL, CIVIC LEAGUE, STATE OR LOCAL GOVERNMENTAL AGENCY, FUND, FOUNDATION, INSTITUTION, HOME OR AGENCY, ORGANIZED AND OPERATED EXCLUSIVELY FOR CHARITABLE, SCIENTIF- IC, HEALTH, AESTHETIC, ARTISTIC, RECREATIONAL, PUBLIC SAFETY, LITERARY, ELEEMOSYNARY OR EDUCATIONAL PURPOSES OR FOR THE PROMOTION OF SOCIAL WELFARE OR THE PURPOSE OF WHICH IS TO PROMOTE THE INFORMED PARTICIPATION OF CITIZENS IN GOVERNMENT. S 2. Section 296 of the executive law is amended by adding a new subdivision 22 to read as follows: 22. IT SHALL BE AN UNLAWFUL DISCRIMINATORY PRACTICE FOR ANY PERSON ACTING ON BEHALF OF ANY ORGANIZATION, ASSOCIATION, SCHOOL, CIVIC LEAGUE, STATE OR LOCAL GOVERNMENTAL AGENCY, FUND, FOUNDATION, INSTITUTION, HOME OR AGENCY, ORGANIZED AND OPERATED EXCLUSIVELY FOR CHARITABLE, SCIENTIF- IC, HEALTH, AESTHETIC, ARTISTIC, RECREATIONAL, PUBLIC SAFETY, LITERARY, ELEEMOSYNARY OR EDUCATIONAL PURPOSES OR FOR THE PROMOTION OF SOCIAL WELFARE OR THE PURPOSE OF WHICH IS TO PROMOTE THE INFORMED PARTICIPATION OF CITIZENS IN GOVERNMENT TO DISCRIMINATE IN THE TERMS, CONDITIONS OR PRIVILEGES OF SUCH ORGANIZATION AGAINST ANY PERSON WHO PERFORMS OR IS SEEKING TO PERFORM VOLUNTEER SERVICES THEREFOR ON THE BASIS OF RACE, CREED, COLOR, NATIONAL ORIGIN, SEX, AGE, DISABILITY OR MARITAL STATUS.
