AN  ACT  to  amend  the executive law, in relation to the inspection and
  maintenance of private fire hydrants and the reporting of such  infor-
  mation

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The executive law is amended by adding a new section  378-a
to read as follows:
  S 378-A. PRIVATE FIRE HYDRANTS. 1. PRIVATE FIRE HYDRANTS SHALL BE:
  A. ANNUALLY INSPECTED, TESTED AND MAINTAINED; AND
  B. INSPECTED, TESTED AND MAINTAINED AFTER EACH OPERATION.
  2.  A.  THE  RESULTS  OF THE INSPECTION REQUIRED BY SUBDIVISION ONE OF
THIS SECTION SHALL BE RECORDED IN A MANNER AND FORM TO BE DETERMINED  BY
THE COUNCIL.
  B.  ALL  FORMS SHALL BE FILED WITH THE CITY, VILLAGE OR TOWN WHERE THE
PRIVATE FIRE HYDRANT IS LOCATED.
  C. AFFIDAVITS SHALL BE SUBMITTED TO THE  COUNTY  CERTIFYING  THAT  THE
PRIVATE  FIRE  HYDRANTS  HAVE  BEEN INSPECTED AND MAINTAINED PURSUANT TO
THIS SECTION AND SUCH INFORMATION HAS BEEN FILED WITH THE CITY,  VILLAGE
OR TOWN.
  3.  FOR  PURPOSES  OF  THIS SECTION "PRIVATE FIRE HYDRANTS" SHALL MEAN
HYDRANTS NOT MAINTAINED BY A MUNICIPALITY OR OTHER GOVERNMENTAL ENTITY.
  S 2. This act shall take effect on the one hundred eightieth day after
it shall have become a law. Effective immediately, the addition,  amend-
ment and/or repeal of any rule or regulation necessary for the implemen-
tation  of this act on its effective date are authorized and directed to
be made and completed on or before such effective date.
