AN  ACT  to amend the social services law, in relation to establishing a
  family health plus sponsor buy-in demonstration program for  qualified
  aliens

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 369-ee of the social services  law  is  amended  by
adding a new subdivision 2-c to read as follows:
  2-C. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, THE DEPART-
MENT  SHALL  ESTABLISH A FAMILY HEALTH PLUS SPONSOR BUY-IN DEMONSTRATION
PROGRAM IN NOT MORE THAN SIX LOCAL SOCIAL SERVICES DISTRICTS  AND  SHALL
PROVIDE  HEALTH  CARE  SERVICES  TO NOT MORE THAN FIVE THOUSAND PERSONS.
SUCH DEMONSTRATION PROGRAM SHALL PROVIDE  ELIGIBILITY  FOR  HEALTH  CARE
SERVICES  PURSUANT  TO  THIS  TITLE  TO  QUALIFIED ALIENS, AS DEFINED IN
SECTION 431 OF THE FEDERAL PERSONAL RESPONSIBILITY AND WORK  OPPORTUNITY
RECONCILIATION ACT OF 1996(8 U.S. CODE 1641), WHOSE SPONSORS HAVE SIGNED
AN  AFFIDAVIT OF SUPPORT PURSUANT TO SECTION 213A OF THE IMMIGRATION AND
NATURALIZATION ACT IF THE QUALIFIED ALIEN IS OTHERWISE ELIGIBLE PURSUANT
TO SUBDIVISION TWO OF THIS SECTION DURING THE PERIODS OF TIME FOR  WHICH
THE  SPONSOR  HAS MADE FAMILY HEALTH PLUS BUY-IN PAYMENTS TO THE DEPART-
MENT OF HEALTH. THE DEPARTMENT OF  HEALTH  SHALL  PROMULGATE  RULES  AND
REGULATIONS  ESTABLISHING  FAMILY  HEALTH  PLUS  BUY-IN RATES; PROVIDED,
HOWEVER, THAT SUCH RATES SHALL NOT EXCEED  TWENTY-FIVE  PERCENT  OF  THE
COST OF THE FAMILY HEALTH INSURANCE PLAN COVERAGE PROVIDED TO THE QUALI-
FIED ALIEN PURSUANT TO THIS SUBDIVISION.
  S 2. This act shall take effect immediately.
