2011-A6413 (ACTIVE) - Summary
Provides that an elected public officer who is convicted of a felony related to his or her position pursuant to article 195 or article 200 of the penal law shall forfeit all benefits of his or her position which are paid by his or her employer, including salary and that portion of his or her retirement.

MURRAY -- read once and referred to the Committee on Governmental Operations AN ACT to amend the public officers law, in relation to loss of benefits of an elected official who is convicted of a felony directly related to such official's elected position THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public officers law is amended by adding a new section 3-d to read as follows: S 3-D. EFFECT OF FELONY CONVICTION. ANY ELECTED PUBLIC OFFICER WHO IS CONVICTED OF A FELONY PURSUANT TO ARTICLE ONE HUNDRED NINETY-FIVE OR ARTICLE TWO HUNDRED OF THE PENAL LAW SHALL, UPON SUCH CONVICTION, FORFEIT ALL BENEFITS, INCLUDING BUT NOT LIMITED TO, SALARY AND RETIRE- MENT PAID BY HIS OR HER EMPLOYER.
