AN  ACT  to  amend  the  education  law, in relation to providing aid to
  school districts for expenses related to the school districts' use  of
  electricity,  propane,  natural gas, and/or heating oil for the school
  year

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  3602 of the education law is amended by adding a
new subdivision 27 to read as follows:
  27. AID FOR ELECTRICITY, PROPANE, NATURAL GAS, AND/OR HEATING OIL  FOR
THE  SCHOOL  YEAR.  A.  COMMENCING  WITH AID PAYABLE IN THE TWO THOUSAND
TWELVE--TWO THOUSAND THIRTEEN SCHOOL YEAR, THE  COMMISSIONER  IS  HEREBY
AUTHORIZED  TO  APPORTION  TO  ANY  SCHOOL DISTRICT AID PURSUANT TO THIS
SUBDIVISION FOR ITS APPROVED EXPENDITURES, IN EXCESS OF  BASE  YEAR  AID
RECEIVED,  FOR  EXPENSES  RELATED  TO  THE COST OF ELECTRICITY, PROPANE,
NATURAL GAS, AND/OR HEATING OIL FOR THE SCHOOL YEAR.
  B. AID PURSUANT TO THIS SUBDIVISION SHALL EQUAL TWENTY-FIVE PERCENT OF
THE SCHOOL DISTRICTS' COST FOR ITS USE OF ELECTRICITY, PROPANE,  NATURAL
GAS, AND/OR HEATING OIL THROUGHOUT THE SCHOOL YEAR.
  S 2. This act shall take effect immediately.
