AN ACT to authorize the designated beneficiary of Kelly Story to file an
application for retroactive membership in the New York state and local
  employees' retirement system

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

Section 1. Notwithstanding any other provision of law to the contrary,
Kelly Story, who was employed from April 25, 1994 through June 2008 as a

participates in the New York state and local employees' retirement
system, shall be deemed to have been in the service upon which member-
ship is based for the purpose of qualifying for the ordinary death bene-
fit provided by section 606 of the retirement and social security law,
and the designated beneficiary of Kelly Story, registration number

the death of Kelly Story, by filing the appropriate application therefor
with the New York state and local employees' retirement system on or

provisions of this act shall be borne by the New York state and local
employees' retirement system.
S 2. This act shall take effect immediately.
FISCAL NOTE.--This bill will deem the late Kelly A. Story's service as
a Teacher's Aide with the City of Buffalo School District to be qualify-
ing service for an Ordinary Death Benefit from the New York State and
Local Employees' Retirement System.
If this bill is enacted, we anticipate that there will be an immediate
past service cost of approximately $30,200 which would be borne by the
State of New York and all the participating employers in the New York
State and Local Employees' Retirement System.
