DINOWITZ -- read once and referred to the Commit- tee on Aging AN ACT to amend the public health law and the elder law, in relation to requiring hospitals to provide long-term care contact information to certain patients THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 2803-t to read as follows: S 2803-T. LONG-TERM CARE CONTACT INFORMATION. THE COMMISSIONER SHALL REQUIRE THAT EVERY HOSPITAL SHALL PROVIDE TO EVERY PATIENT ANTICIPATED TO BE IN NEED OF LONG-TERM CARE, CONTACT INFORMATION AT THE TIME SUCH DETERMINATION IS MADE FOR AT LEAST ONE POINT OF CONTACT IN THE PATIENT'S COUNTY OF RESIDENCE FOR THE NY CONNECTS: CHOICES FOR LONG TERM CARE PROGRAM ESTABLISHED PURSUANT TO SUBDIVISION EIGHT OF SECTION TWO HUNDRED THREE OF THE ELDER LAW, OR IN THE EVENT THAT SUCH POINT OF CONTACT DOES NOT EXIST IN THE PATIENT'S COUNTY OF RESIDENCE, CONTACT INFORMATION FOR THE AGENCY ON AGING SERVING THE PATIENT'S COUNTY OF RESIDENCE, AND ANY OTHER INFORMATION APPROPRIATE TO THE NEEDS AND CHARACTERISTICS OF THE PATIENT, INCLUDING BUT NOT LIMITED TO LOCAL INDEPENDENT LIVING CENTERS, LOCAL DEPARTMENTS OF SOCIAL SERVICES AND LOCAL DEPARTMENTS OF HEALTH. S 2. Subdivision 8 of section 203 of the elder law, as added by section 18 of part B of chapter 58 of the laws of 2007, is amended to read as follows: [8.] 9. The director, in consultation with the commissioner of health, shall establish a program to be known as the NY Connects: Choices for Long Term Care. The purpose of this initiative is to provide consistent, comprehensive, locally-based information and assistance on long term care services to consumers, caregivers and families to help them make educated choices. THE COMMISSIONER SHALL, IN CONJUNCTION WITH THE STATE OFFICE FOR THE AGING, CREATE A LIST OF CONTACT INFORMATION FOR THE NY CONNECTS: CHOICES FOR LONG TERM CARE PROGRAM ESTABLISHED PURSUANT TO SUBDIVISION EIGHT OF SECTION TWO HUNDRED THREE OF THE ELDER LAW, LOCAL AREA AGENCIES ON AGING, LOCAL DEPARTMENTS OF SOCIAL SERVICES, AND LOCAL DEPARTMENTS OF HEALTH TO BE ORGANIZED BY COUNTY, PROVIDED THAT IN A CITY WITH A POPU- LATION OF ONE MILLION OR MORE, SUCH CONTACT INFORMATION FOR LOCAL AGEN- CIES MAY BE THE GOVERNMENT INFORMATION AND NON-EMERGENCY SERVICES CITI- ZEN SERVICE CENTER IN SUCH CITY. THIS LIST SHALL BE UPDATED PERIODICALLY AS NEEDED. THE COMMISSIONER SHALL PROVIDE SUCH LIST TO HEALTH CARE PRAC- TITIONERS CERTIFIED OR LICENSED UNDER THIS CHAPTER AND, IN CONJUNCTION WITH THE COMMISSIONER OF EDUCATION, TO ALL HEALTH CARE PROVIDERS AND HEALTH CARE PRACTITIONERS LICENSED UNDER THE EDUCATION LAW. 2. WHENEVER A HEALTH CARE PROVIDER OR PRACTITIONER MAKES A RECOMMENDA- TION REGARDING THE NECESSITY OF LONG TERM CARE SERVICES OR A REFERRAL FOR THE RECEIPT OF LONG TERM CARE SERVICES TO A PATIENT, THE PATIENT OR PATIENT'S DESIGNATED REPRESENTATIVE SHALL BE PROVIDED BY THE HEALTH CARE PROVIDER OR PRACTITIONER THE CONTACT INFORMATION FROM THE LIST CREATED PURSUANT TO SUBDIVISION ONE OF THIS SECTION THAT CORRESPONDS TO THE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
