AN ACT in relation to allowing Richard Merrill and Frederick Akshar to
join the special retirement plan for sheriffs, undersheriffs and depu-
ty sheriffs
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Notwithstanding any other provision of law, Richard Merrill
and Frederick Akshar, who are each employed as a deputy sheriff in the
county of Broome, and who are each a member of the New York state and
local employees' retirement system, and who were each eligible to make
the election pursuant to section 551 of the retirement and social secu-
rity law to join the special retirement plan for sheriffs, undersheriffs
and deputy sheriffs engaged in law enforcement activities, but who, for
reasons not ascribable to their own individual negligence, failed to
make such election to join such special retirement plan, shall each be
eligible to individually join such special retirement plan if on or
before December 31, 2011 they file a written request with the state
comptroller to that effect.
S 2. All costs incurred by the implementation of this act shall be
borne by the county of Broome.
S 3. This act shall take effect immediately.
FISCAL NOTE.--Pursuant to Legislative Law, Section 50:
This legislation would allow Broome County to reopen the provisions of
Section 552 of the Retirement and Social Security Law for two deputy
sheriffs.
In estimating this cost, we have assumed the following:

S. 5719 2 A. 8317
1. The legislation, when drafted, would affect only Richard Merrill
and Frederick Akshar.
2. The legislation would specify that all costs incurred due to its
enactment would be borne by Broome County.
3. There are no other deputy sheriffs employed by Broome County who
are involved in criminal law enforcement at least 50% of the time that
are not currently covered by the provisions of Section 552.
If this legislation is enacted during the 2011 legislative session, we
anticipate that there would be an increase of approximately $13,400 in
the annual contributions of Broome County for the fiscal year ending
March 31, 2012.
In addition to the annual contributions discussed above, there would
be an immediate past service cost of approximately $23,300, which would
be borne by Broome County as a one-time payment. This estimate is based
on the assumption that payment would be made on February 1, 2012.
