BILL NUMBER:S1661 TITLE OF BILL: An act to amend the education law, in relation to prohibiting retirement agreements between teachers accused of misconduct and school districts PURPOSE: To forbid retirement agreements between school districts and teachers accused of misconduct unless the agreement includes the voluntary surrender of teaching certificate or license. SUMMARY OF PROVISIONS: The Education law is amended by adding a new section 301l-a that prohibits retirement agreements between teachers accused of misconduct and school districts unless the teacher in question agrees to surrender his/her teaching license or teaching certificate. Provides for return of the teaching license/certificate upon exoneration from the allegations of misconduct. JUSTIFICATION: Recently the New York State Commission on Investigation investigated the case of a teacher in Putnam County accused of molesting one student and acting inappropriately towards other students in the same school. SAMPSON -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to prohibiting retirement agreements between teachers accused of misconduct and school districts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 3011-a to read as follows: S 3011-A. PROHIBITION OF RETIREMENT AGREEMENTS BETWEEN TEACHERS ACCUSED OF MISCONDUCT AND SCHOOL DISTRICTS. NO RETIREMENT AGREEMENT BETWEEN A TEACHER ACCUSED OF MISCONDUCT AND A SCHOOL DISTRICT SHALL BE MADE UNLESS SUCH AGREEMENT INCLUDES THE VOLUNTARY SURRENDER OF SUCH TEACHER'S LICENSE OR TEACHING CERTIFICATE ISSUED PURSUANT TO SECTION THREE THOUSAND SIX OF THIS ARTICLE. HOWEVER, IF SUCH TEACHER IS EXONER- ATED OF SUCH ALLEGED MISCONDUCT, SUCH TEACHER MAY AGAIN BE ISSUED HIS OR HER TEACHER'S LICENSE OR TEACHING CERTIFICATE. S 2.
