TITLE OF BILL:
An act
to amend the domestic relations law, in relation to grounds for an
action for divorce
SUMMARY:
This bill would add a new subdivision 7 to section 170 of the domestic
relations law. This bill would allow that an action for divorce may
be maintained by a husband or wife to procure a judgment divorcing
the parties and dissolving the parties and dissolving the marriage
upon conviction and sentencing of a class A felony; and/or a class B
or C violent felony as defined in section 70.02 of the penal law;
and/or the final conviction of the defendant for a felony sex offense
as defined in article one hundred thirty of the penal law.
JUSTIFICATION:
Grounds for divorce in New York are purely statutory. The grounds in
which a divorce may be granted have not been expanded since 1966.
Under current law, a spouse may file for divorce on the ground of
imprisonment, only after their spouse has been imprisoned for three
years. This provision would allow the non imprisoned spouse the
option of filing for divorce upon the defendant spouse's conviction
of the aforementioned felony offense(s).

AN ACT to amend the domestic relations law, in relation to grounds for
an action for divorce
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 170 of the domestic relations law is amended by
adding a new subdivision 8 to read as follows:
(8) UPON SENTENCING OF THE DEFENDANT AFTER CONVICTION FOR A CLASS A
FELONY, CLASS B OR C VIOLENT FELONY AS DEFINED IN SECTION 70.02 OF THE
PENAL LAW, OR FELONY SEX OFFENSE AS DEFINED IN ARTICLE ONE HUNDRED THIR-
TY OF THE PENAL LAW.
S 2. This act shall take effect on the thirtieth day after it shall
have become a law.
