BILL NUMBER:S3239 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to establishing distinctive Gadsden flag plates PURPOSE OR GENERAL IDEA OF BILL: Establishes a distinctive Gadsden flag plate which shall include the phrase "DON'T TREAD ON ME." SUMMARY OF SPECIFIC PROVISIONS: Section 1. The Vehicle and Traffic Law is amended by adding a new section 404-x providing for a Gadsden flag license plate consisting of a coiled rattlesnake and the phrase "DON'T TREAD ON ME" Section 2. Provides that these plates shall be issued in the same manner as other plates and that all applicable fees and procedures will apply. JUSTIFICATION: The Gadsden flag, designed by American General and Statesman Christopher Gadsden was first used in 1775 and used as the personal standard of the of the first commander-in-Chief of the Continental Navy. MAZIARZ, JOHNSON, RANZENHOFER, SEWARD -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to establishing distinctive Gadsden flag plates THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The vehicle and traffic law is amended by adding a new section 404-x to read as follows: S 404-X. DISTINCTIVE GADSDEN FLAG PLATES. 1. ANY PERSON RESIDING IN THIS STATE SHALL, UPON REQUEST, BE ISSUED A DISTINCTIVE GADSDEN FLAG PLATE OF A DESIGN APPROVED BY THE COMMISSIONER WHICH SHALL INCLUDE THE COILED RATTLESNAKE DEPICTED ON THE GADSDEN FLAG AND BEAR THE PHRASE "DON'T TREAD ON ME". APPLICATION FOR SUCH PLATE SHALL BE FILED WITH THE COMMISSIONER IN SUCH FORM AND DETAIL AS THE COMMISSIONER SHALL PRESCRIBE. 2. A DISTINCTIVE PLATE ISSUED PURSUANT TO THIS SECTION SHALL BE ISSUED IN THE SAME MANNER AS OTHER NUMBER PLATES UPON PAYMENT OF THE REGULAR REGISTRATION FEE PRESCRIBED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE; PROVIDED, HOWEVER, THAT AN ADDITIONAL ANNUAL SERVICE CHARGE OF TWENTY-FIVE DOLLARS SHALL BE CHARGED FOR SUCH PLATE. SUCH ANNUAL SERVICE CHARGE SHALL BE DEPOSITED, PURSUANT TO SECTION FOUR HUNDRED FOUR-OO OF THIS ARTICLE, TO THE CREDIT OF THE DEPARTMENT OF MOTOR VEHICLES DISTINC- TIVE PLATE DEVELOPMENT FUND, ESTABLISHED BY SECTION NINETY-FIVE-G OF THE STATE FINANCE LAW, AND SHALL BE USED FOR THE PRODUCTION, DESIGN, ADVER- TISING AND MARKETING OF DISTINCTIVE PLATES PURSUANT TO SUCH SECTION NINETY-FIVE-G.
