BILL NUMBER:S3325 TITLE OF BILL: An act to amend the correction law, in relation to sex offender registration PURPOSE: To help insure that sex offenders are held responsible for knowing what the state and local residency and employment laws are in the community verifying they are in compliance with them. SUMMARY OF PROVISIONS: Amends sections (b) and (b-1) of Section 168-F(2) of the Correction Law. EXISTING LAW: The present law requires verification of residency and employment but does not put the burden on the offenders of verifying that they are in compliance with state and local laws that regulate residency and employment. JUSTIFICATION: The State and Localities have imposed numerous laws regulating where a sex offender can reside or work. This bill places the obligation on the offender of knowing those laws, complying with them and verifying their compliance.

THIELE -- read once and referred to the Committee on Correction AN ACT to amend the correction law, in relation to sex offender regis- tration THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 2 of section 168-f of the correction law, as added by chapter 192 of the laws of 1995, is amended to read as follows: (b) The verification form shall be signed by the sex offender, and state that he OR SHE still resides at the address last reported to the division, THAT HE OR SHE IS IN COMPLIANCE WITH ALL STATE, COUNTY AND LOCAL RESIDENCY LAWS AND LAWS REGARDING THE EMPLOYMENT OF SEX OFFENDERS. S 2. Paragraph (b-1) of subdivision 2 of section 168-f of the correction law, as amended by chapter 10 of the laws of 2003, is amended to read as follows: (b-1) If the sex offender has been given a level three designation, such offender shall sign the verification form, and state that he or she still is employed at the address last reported to the division AND THAT HE OR SHE IS IN COMPLIANCE WITH ALL STATE, COUNTY AND LOCAL RESIDENCY LAWS AND LAWS REGARDING THE EMPLOYMENT OF SEX OFFENDERS. S 3. This act shall take effect on the sixtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
