BILL NUMBER:S3794 TITLE OF BILL: An act to amend the navigation law and the general business law, in relation to restrictions on jet skis SUMMARY OF SPECIFIC PROVISIONS: The amendment requires that no one under the age of eighteen years can buy a jet ski without the permission of a parent. It also requires that jet skiers must wear a protective helmet and take a safety course. JUSTIFICATION: Under current law, a person under 18 may purchase a jet ski without parental permission. This bill makes sure that a parent is involved in the decision to purchase a jet ski which can be very dangerous for inexperienced users. This bill also requires a safety course to be taken as well as to mandate the wearing of a protective helmet. There have been many tragic accidents occurring each year because of a lack of requirements in this area. FISCAL IMPLICATION: None.

KRUGER -- read twice and ordered print- ed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation IN ASSEMBLY -- Introduced by M. of A. MAISEL -- read once and referred to the Committee on Transportation AN ACT to amend the navigation law and the general business law, in relation to restrictions on jet skis THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1-a of section 49 of the navigation law is renumbered subdivision 1-b and a new subdivision 1-a is added to read as follows: 1-A. THE PROVISIONS OF THIS SECTION SHALL APPLY TO JET SKIS, WHICH, FOR PURPOSES OF THIS SECTION SHALL MEAN ANY SMALL SELF-PROPELLED WATER- CRAFT FOR ONE OR TWO INDIVIDUALS, WHICH SKIMS ACROSS WATER ON A FLAT KEEL, AND IS STEERED BY MEANS OF HANDLEBARS. S 2. The general business law is amended by adding a new section 391-r to read as follows: S 391-R. SALE OF JET SKIS. PERSONS UNDER THE AGE OF EIGHTEEN YEARS SHALL BE PROHIBITED FROM PURCHASING JET SKIS, AS SUCH TERM IS DEFINED IN SECTION FORTY-NINE OF THE NAVIGATION LAW UNLESS SUCH PERSON IS ACCOMPA- NIED BY A PARENT OR LEGAL GUARDIAN. S 3. Subdivision 1-b of section 49 of the navigation law, as renum- bered by section one of this act, is amended by adding a new paragraph b-1 to read as follows: B-1. NO PERSON SHALL OPERATE A JET SKI UPON THE NAVIGABLE WATERS OF THE STATE OR ANY TIDEWATERS BORDERING ON OR LYING WITHIN THE BOUNDARIES OF NASSAU AND SUFFOLK COUNTIES UNLESS SUCH PERSON WEARS A PROTECTIVE HELMET AND IS THE HOLDER OF A BOARD SAFETY CERTIFICATE ISSUED BY THE COMMISSIONER, THE UNITED STATES POWER SQUADRONS, THE UNITED STATES COAST GUARD AUXILIARY OR OTHER STATE OR GOVERNMENT, AS A RESULT OF COMPLETING A COURSE APPROVED BY THE COMMISSIONER. S 4. This act shall take effect immediately.
