BILL NUMBER:S3844 TITLE OF BILL: An act to amend chapter 397 of the laws of 1996, relating to authorizing the town of Islip to lease certain lands to a business corporation, in relation to the lease term PURPOSE OR GENERAL IDEA OF BILL: To extend the term of any lease for any parkland located in Hidden Pond Park to be for a period of fifty years SUMMARY OF SPECIFIC PROVISIONS: Section 1 of the bill amends subdivision (a) of section 1 of chapter 397 of the laws of 1996 by increasing the maximum allowable time for a lease from thirty years to fifty years. JUSTIFICATION: On July 30, 1996, New York State enacted a law entitled the "Laws of New York, Chapter 397", which authorized the Town of Islip to lease certain municipally-owned parkland located in Hidden Pond Park, Hauppauge, to a business corporation. The Law authorized the term of any lease to be for a period of thirty years. The Parkland lease to a business corporation has provided the citizens of Hauppauge with sports and recreation opportunities for close to

Subdivision (a) of section 1 of chapter 397 of the laws of 1996, relating to authorizing the town of Islip to lease certain lands to a business corporation, is amended to read as follows: (a) Notwithstanding the provisions of any other general, special or local law, rule or regulation to the contrary, the town of Islip, in the county of Suffolk, is hereby authorized and empowered to lease the lands hereinafter described for up to [thirty] FIFTY years, to a business corporation for such consideration for fair market value and upon such terms, conditions and provisions as the town board in its discretion may deem proper.
