Prohibits a licensed insurance carrier or certified health maintenance organization from disclosing to a claimant's employer the fact that an insurance claim for a surgical procedure has been submitted under the provisions of an insurance policy or contract between an HMO and an enrollee.

AN ACT to amend the insurance law, in relation to prohibiting disclosure
  of  a  claim  for  surgical  procedure to the employer by an insurance
  carrier

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The insurance law is amended by adding a new section 3114
to read as follows:
  S 3114. PROHIBITION OF DISCLOSURE OF A SURGICAL PROCEDURE UNDER INSUR-
ANCE POLICIES. NO INSURER LICENSED UNDER THIS CHAPTER OR HEALTH  MAINTE-
NANCE  ORGANIZATION  CERTIFIED  UNDER  ARTICLE  FORTY-FOUR OF THE PUBLIC
HEALTH LAW SHALL DISCLOSE TO THE EMPLOYER OF A COVERED PERSON  THE  FACT
THAT  A  CLAIM  FOR  A  SURGICAL  PROCEDURE HAS BEEN SUBMITTED UNDER THE
PROVISIONS OF AN INSURANCE POLICY OR CONTRACT BETWEEN A  HEALTH  MAINTE-
NANCE ORGANIZATION AND AN ENROLLEE.
  S  2.  This  act shall take effect on the ninetieth day after it shall
have become a law.  Effective  immediately  any  rules  and  regulations
necessary  for  the  timely  implementation of this act on its effective
date shall be promulgated on or before such date.
