AN ACT to amend the insurance law, in relation to prohibiting disclosure
of a claim for surgical procedure to the employer by an insurance
carrier
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The insurance law is amended by adding a new section 3114
to read as follows:
S 3114. PROHIBITION OF DISCLOSURE OF A SURGICAL PROCEDURE UNDER INSUR-
ANCE POLICIES. NO INSURER LICENSED UNDER THIS CHAPTER OR HEALTH MAINTE-
NANCE ORGANIZATION CERTIFIED UNDER ARTICLE FORTY-FOUR OF THE PUBLIC
HEALTH LAW SHALL DISCLOSE TO THE EMPLOYER OF A COVERED PERSON THE FACT
THAT A CLAIM FOR A SURGICAL PROCEDURE HAS BEEN SUBMITTED UNDER THE
PROVISIONS OF AN INSURANCE POLICY OR CONTRACT BETWEEN A HEALTH MAINTE-
NANCE ORGANIZATION AND AN ENROLLEE.
S 2. This act shall take effect on the ninetieth day after it shall
have become a law. Effective immediately any rules and regulations
necessary for the timely implementation of this act on its effective
date shall be promulgated on or before such date.
