TITLE OF BILL:
An act
to amend the executive law, in relation to providing
information on victim and witness
assistance programs to crime victims

PURPOSE OF GENERAL IDEA OF BILL:
To provide crime victims with information on victim assistance
programs available to them following victimization. This legislation
requires that information given to victims about victim assistance
programs at such places as the police station, precinct house,
hospital emergency room, domestic violence shelter or homeless
shelter, shall be limited to those programs funded by the Crime
victims Board (CVB) and domestic violence related programs licensed
and approved by the Office of Children and Family services (OCFS) to
ensure accuracy.

SUMMARY OF SPECIFIC PROVISIONS:
Subdivision 1 of section 625-a of the executive law, subdivision 1 as
amended- by chapter 173 of the laws of 2006 is being amended.
Subdivision 1 of section 625-b of the executive law as added by
chapter 173 of the laws, of 2006 is amended.

JUSTIFICATION:

The need for accurate information regarding victim assistance programs
is extremely important. One who has been criminally victimized often
suffers severe physical, psychological and/or financial impairment.

Adequate help from the very beginning can encourage "functional
reconstruction" of the victim so that later psychological
intervention is less likely to be necessary. This important
assistance can often take place if the crime victim is given adequate
information, especially since one who has been victimized may be in a
state of shock or confusion and desperately needs support, but may be
unable to get it unassisted.

This legislation provides that only information on those victim
assistance programs funded by the CVB as well as those domestic
violence programs licensed and approved by the OCFS shall be
provided. The CVB carefully vets and continuously monitors the victim
assistance programs that it funds to ensure that these programs
provide accurate and useful information to victims in their time of
need.

PRIOR LEGISLATIVE HISTORY:
S.1538E Passed Senate 6/18/10; A.3923 Passed
Assembly 6/25/10. Veto Memo 6718 7/30/10. The bill will be amended to
reflect the concerns in the veto message.

FISCAL IMPLICATIONS:
$5,000 to $10,000 for information preparation and
distribution by the Crime Victims Board.

EFFECTIVE DATE:


This act shall take effect on the one hundred and eightieth day
after it shall have become a law.

AN  ACT to amend the executive law, in relation to providing information
  on victim and witness assistance programs to crime victims

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision  1  of section 625-a of the executive law, as
amended by section 15 of part A-1 of chapter 56 of the laws of 2010,  is
amended to read as follows:
  1.  Every police station, precinct house, GENERAL HOSPITAL ESTABLISHED
UNDER THE LAWS OF THIS STATE WHICH MAINTAINS  FACILITIES  FOR  PROVIDING
OUT-PATIENT  EMERGENCY MEDICAL CARE, DOMESTIC VIOLENCE SHELTER, HOMELESS
SHELTER, any appropriate location where a crime may, OR MUST  UNDER  THE
OFFICE'S RULES AND REGULATIONS, be reported and any location required by
the rules and regulations of the office shall have available informative
booklets,  pamphlets  and other pertinent written information, including
information cards, to be supplied by the office, relating to the  avail-
ability  of  crime victims compensation including all necessary applica-
tion blanks required to be filed with the office and shall display prom-
inently  posters  giving  notification  of  the  existence  and  general
provisions  of  this  article,  those  provisions  of the penal law that
prohibit the intimidation of crime victims and the location of the near-
est crime victim service program. The office may  issue  guidelines  for
the  location  of  such  display  and shall provide posters, application
forms, information cards  and  general  information.  Every  victim  who
reports a crime in any manner whatsoever shall be given notice about the
rights of crime victims and the existence of all relevant local victim's
assistance  programs  and  services  THAT  ARE  FUNDED BY THE OFFICE AND
PROGRAMS AND SERVICES THAT ARE LICENSED AND APPROVED BY  THE  OFFICE  OF
CHILDREN AND FAMILY SERVICES, INCLUDING, BUT NOT LIMITED TO, RAPE CRISIS

CENTERS,  ELDERLY VICTIM PROJECTS, VICTIM ASSISTANCE HOTLINES AND DOMES-
TIC VIOLENCE SHELTERS AND PROGRAMS pursuant to section six hundred twen-
ty-five-b of this article, and supplied  by  the  person  receiving  the
report with information, application blanks, and information cards which
shall  clearly  state:  (a) that crime victims may be eligible for state
compensation benefits; (b) the address and phone number of  the  office;
(c)  that police and district attorneys can help protect victims against
harassment and intimidation; (d) the  addresses  and  phone  numbers  of
local  victim  service  programs  FUNDED BY THE OFFICE AND SUCH PROGRAMS
LICENSED AND APPROVED BY THE OFFICE OF  CHILDREN  AND  FAMILY  SERVICES,
where  appropriate,  or space for inserting that information AND A BRIEF
DESCRIPTION OF THE SERVICES PROVIDED BY SUCH PROGRAMS; or (e) any  other
information  the  office deems appropriate. Such cards shall be designed
by the office in consultation with local police, and  shall  be  printed
and  distributed  by  the  office. The office shall develop a system for
distributing a sufficient supply of the information cards referred to in
this subdivision, to all the  appropriate  designated  locations,  which
shall include a schedule for meeting that requirement.
  S  2.  Subdivision 1 of section 625-b of the executive law, as amended
by section 16 of part A-1 of chapter 56 of the laws of 2010, is  amended
to read as follows:
  1.  The  commissioner  of the division of criminal justice services in
cooperation with the office shall develop and implement  a  standardized
procedure  to  be  used by police officers, county sheriffs' departments
[and], GENERAL HOSPITALS ESTABLISHED UNDER THE LAWS OF THIS STATE  WHICH
MAINTAIN  FACILITIES  FOR  PROVIDING OUT-PATIENT EMERGENCY MEDICAL CARE,
DOMESTIC VIOLENCE SHELTERS, HOMELESS SHELTERS AND state police  officers
whereby  victims of crime are notified about the rights of crime victims
and the existence of programs FUNDED BY THE OFFICE AND PROGRAMS LICENSED
AND APPROVED BY THE OFFICE OF CHILDREN AND FAMILY SERVICES  designed  to
assist crime victims.
  S 3. This act shall take effect on the one hundred eightieth day after
it shall have become a law.
