BILL NUMBER:S4902 TITLE OF BILL: An act to amend the education law, in relation to authorizing the commissioner of education to conduct a study identifying paperwork requirements and developing and implementing a five year paperwork reduction plan PURPOSE: This legislation would require the Commissioner of Education to reduce the paperwork burden of schools, school districts and Boards of Cooperative Educational Services by 10 percent each year for five years following a study identifying the paperwork requirement for all schools.. SUMMARY OF PROVISIONS: This bill amends section 305 of the Education Law by adding a new subdivision 42. The law would require the Commissioner of Education to conduct a study to identify the current volume of paperwork now required by law, rule or regulation. This legislation would also require the study to report the estimated costs of completing and submitting required paperwork records through the use of an electronic medium such as the Internet. The study would be completed by January 1, 2012, and would include the estimated costs to the schools, school districts and BOCES associated with the completion of this paperwork. SCHIMMINGER -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to authorizing the commissioner of education to conduct a study identifying paperwork requirements and developing and implementing a five year paperwork reduction plan THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 305 of the education law is amended by adding a new subdivision 42 to read as follows: 42. A. THE COMMISSIONER IS AUTHORIZED AND DIRECTED TO CONDUCT A STUDY THAT WILL IDENTIFY THE PAPERWORK REQUIREMENTS AS ESTABLISHED BY STATE STATUTE, RULE OR REGULATION PROMULGATED BY THE DEPARTMENT FOR ALL SCHOOLS. B. FOR THE PURPOSES OF THIS SUBDIVISION, PAPERWORK SHALL INCLUDE, BUT NOT BE LIMITED TO ALL CERTIFICATES, REPORTS, FORMS OR OTHER REQUIRED TYPES OF COMMUNICATION THAT INVOLVE OR TERMINATE IN A PAPER RECORD. C. THIS STUDY SHALL BE COMPLETED BY JANUARY FIRST, TWO THOUSAND TWELVE AND SHALL IDENTIFY A LIST OF SUCH PAPERWORK AND DETERMINE THE TOTAL VOLUME OF ALL PAPERWORK REQUIREMENTS FOR EACH INDIVIDUAL SCHOOL, SCHOOL DISTRICT AND BOARD OF COOPERATIVE EDUCATIONAL SERVICES AND A COMBINED TOTAL FOR ALL SCHOOLS, SCHOOL DISTRICTS AND BOARDS OF COOPERATIVE EDUCA- TIONAL SERVICES STATEWIDE, OF PAPERWORK AS DEFINED IN THIS SUBDIVISION. THIS LIST SHALL ALSO INCLUDE THE ESTIMATED COSTS, IN MATERIALS AND LABOR, TO THE SCHOOLS, SCHOOL DISTRICTS AND BOARDS OF COOPERATIVE EDUCA- TIONAL SERVICES AND THE DEPARTMENT ASSOCIATED WITH THE COMPLETION OF SUCH PAPERWORK RECORDS.
