BILL NUMBER:S5173 REVISED 08/22/11 TITLE OF BILL: An act to amend the education law, in relation to ensuring that special education children are provided with transportation to preschool by their parents if the parents have the means and ability to provide such transportation PURPOSE: To encourage parents of children receiving preschool special education services to independently provide transportation to and from services. SUMMARY OF PROVISIONS: Section 1. Requires parents to certify whether they can independently transport their children to preschool special education services. Provides that per diem reimbursement to the parents shall be paid within 30 days of a claim being submitted. Section 2. This act shall take effect immediately. EXISTING LAW: Some localities choose to inquire whether parents can provide independent transportation to their children for preschool special education services.

GALLIVAN -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to ensuring that special education children are provided with transportation to preschool by their parents if the parents have the means and ability to provide such transportation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 8 of section 4410 of the education law, as amended by chapter 474 of the laws of 1996, is amended to read as follows: 8. Transportation. The municipality in which a preschool child resides shall, beginning with the first day of service, provide either directly or by contract for suitable transportation, as determined by the board, to and from special services or programs; provided, however, that if the municipality is a city with a population of one million or more persons the municipality may delegate the authority to provide such transporta- tion to the board; and provided further, that prior to providing such transportation directly or contracting with another entity to provide such transportation, such municipality or board shall request and encourage the parents to transport their children at public expense, where cost-effective, at a rate per mile or a public service fare estab- lished by the municipality and approved by the commissioner. TO FURTHER ENCOURAGE PARENT PROVIDED TRANSPORTATION, REIMBURSEMENT PAYMENTS FOR PARENTAL TRANSPORTATION SHALL BE PAID WITHIN THIRTY DAYS FROM THE DATE A VALID REIMBURSEMENT REQUEST IS FILED WITH THE MUNICIPALITY. Except as otherwise provided in this section, the parents' inability [or declina- tion] to transport their child shall in no way [effect] AFFECT the municipality's or board's responsibility to provide recommended services.
