BILL NUMBER:S534 TITLE OF BILL: An act to amend the public authorities law, in relation to review of taxpayer-funded contracts with public authorities in a city with a population of over one million PURPOSE: Allows public authority in a city with a population of over 1 million to cancel taxpayer-funded contract where contractor convicted of related crime. SUMMARY OF PROVISIONS: The legislation amends article 9 of the Public Authorities law by adding a new Title 13, §2990 providing grounds for cancellation of contract by public authorities in a city with a population of over 1 million. KLEIN -- read twice and ordered printed, and when printed to be committed to the Committee on Corporations, Authorities and Commissions AN ACT to amend the public authorities law, in relation to review of taxpayer-funded contracts with public authorities in a city with a population of over one million THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Article 9 of the public authorities law is amended by adding a new title 13 to read as follows: TITLE 13 TAXPAYER-FUNDED CONTRACTS WITH PUBLIC AUTHORITIES IN A CITY WITH A POPULATION OF OVER ONE MILLION SECTION 2990. GROUNDS FOR CANCELLATION OF CONTRACT BY PUBLIC AUTHORI- TIES. S 2990. GROUNDS FOR CANCELLATION OF CONTRACT BY PUBLIC AUTHORITIES. ANY TAXPAYER-FUNDED CONTRACT FOR THE PROCUREMENT OF GOODS, SERVICES OR CONSTRUCTION WITH AN AUTHORITY OR COMMISSION CONTINUED OR CREATED BY THIS CHAPTER, WHOSE JURISDICTION IS LIMITED TO A CITY WITH A POPULATION OF OVER ONE MILLION SHALL BE REVIEWED BY THE COMPTROLLER OF SUCH CITY. IF THE COMPTROLLER FINDS THAT THE CONTRACTOR WHO HAS BEEN AWARDED THE CONTRACT HAS BEEN CONVICTED OF A CRIME WITHIN FIVE YEARS OF THE AWARDING OF THE CONTRACT, DIRECTLY RELATED TO CONTRACT PROCUREMENT OR PERFORM- ANCE, INCLUDING BUT NOT LIMITED TO BID RIGGING, FRAUDULENT BILLING OR ACCOUNTING, PREVAILING WAGE VIOLATIONS AND OSHA VIOLATIONS, THE AUTHORI- TY OR COMMISSION MAY CANCEL OR TERMINATE SUCH CONTRACT WITHOUT INCURRING ANY PENALTY OR DAMAGES ON ACCOUNT OF SUCH CANCELLATION OR TERMINATION.
