BILL NUMBER:S6547 TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to removing restrictions on wine and liquor auctions PURPOSE: To remove restrictions on wine and liquor auctions. SUMMARY OF PROVISIONS: Section one amends paragraph (b) of subdivision 2 of section 99-g of the alcoholic beverage control law by removing the restriction that a wine and liquor auction permit shall allow the holder to conduct twelve auctions of wine and/or liquor during the period the wine and liquor permit shall be in effect. Section two provides the effective date. JUSTIFICATION: Wine and liquor retailers must obtain a wine and liquor auction permit each year, which limits them to conducting only twelve auctions for the year. This bill will still require the retailers to obtain the permit, but the permit would not restrict the number of auctions that may be held. Paragraph (b) of subdivision 2 of section 99-g of the alco- holic beverage control law, as amended by chapter 530 of the laws of 2007, is amended to read as follows: (b) A wine and liquor auction permit shall be issued for a calendar year. [A wine and liquor auction permit shall allow the holder to conduct twelve auctions of wine and/or liquor during the period the wine and liquor auction permit shall be in effect.] S 2.
