AN ACT to amend the vehicle and traffic law, in relation to motor  vehi-
  cle repair shop exclusions

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph (d) of subdivision 2  of  section  398-b  of  the
vehicle  and traffic law, as amended by chapter 212 of the laws of 1980,
is amended and a new paragraph (e) is added to read as follows:
  (d) any person solely engaged in the business  of  repairing  farm  or
road  building  machines,  or such other utility vehicles as the commis-
sioner may by regulation designate[.]; OR
  (E) ANY PERSON OR ENTITY WHOSE ACTIVITIES PRIMARILY CONSIST OF RESTOR-
ING, REBUILDING OR CUSTOMIZING SPECIALTY MOTOR VEHICLES OR  MOTOR  VEHI-
CLES AT LEAST TWENTY-FIVE YEARS OLD.
  S  2.  This  act  shall take effect on the sixtieth day after it shall
have become a law.
