AN ACT to amend the general municipal law, in relation to the definition
  of consolidation for the consolidation in dissolution of local govern-
  ment

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1. Subdivision 2 of section 750 of the general municipal law,
as added by chapter 74 of the laws  of  2009,  is  amended  to  read  as
follows:
  2.  "Consolidation"  shall mean [either] (a) the combination of two or
more local government entities  resulting  in  the  termination  of  the
existence of each of the entities to be consolidated and the creation of
a new entity which assumes jurisdiction over all of the terminated enti-
ties[, or]; (b) the combination of two or more local government entities
resulting  in  the  termination  of  the existence of all but one of the
entities which shall absorb the terminated entity or  entities;  OR  (C)
THE  ALTERATION  OF  THE  BORDERS  OF A VILLAGE TO BE COTERMINOUS WITH A
TOWN.
  S 2. This act shall take effect immediately.

WHEN THE IMPLEMENTATION OF SUCH CONTERMINOUS BORDERS CAN BE DEMONSTRATED
BY  THE  TOWN  AND VILLAGE TO THE SATISFACTION OF THE SECRETARY OF STATE
THAT A CONSOLIDATION OF SERVICES SHALL OCCUR PRODUCING A NET SAVINGS  TO
PROPERTY TAXPAYERS.
  S 2. This act shall take effect immediately.
