BILL NUMBER:S6761 TITLE OF BILL: An act to amend the general municipal law, in relation to the definition of consolidation for the consolidation in dissolution of local government PURPOSE: To expand the definition of the term "consolidation" for purposes of the "citizen empowerment tax credit" and the "local government citizens re-organization empowerment grant program" to include the creation of a coterminous village and town government. SUMMARY OF PROVISIONS: Section 1. Amends subdivision 2 of section 750 of the general municipal law to include "the alteration of the borders of a village to be coterminous with a town" within the definition of the term "consolidation" Section 2. Effective Date. JUSTIFICATION: Current law does not include the creation of a coterminous village and town government within the definition of consolidation for the purpose of the "citizen empowerment tax credit" or the "local government citizens reorganization empowerment grant program."

BONACIC -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the general municipal law, in relation to the definition of consolidation for the consolidation in dissolution of local govern- ment THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 750 of the general municipal law, as added by chapter 74 of the laws of 2009, is amended to read as follows: 2. "Consolidation" shall mean [either] (a) the combination of two or more local government entities resulting in the termination of the existence of each of the entities to be consolidated and the creation of a new entity which assumes jurisdiction over all of the terminated enti- ties[, or]; (b) the combination of two or more local government entities resulting in the termination of the existence of all but one of the entities which shall absorb the terminated entity or entities; OR (C) THE ALTERATION OF THE BORDERS OF A VILLAGE TO BE COTERMINOUS WITH A TOWN. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD15002-01-2
