BILL NUMBER:S6765 TITLE OF BILL: An act to amend the parks, recreation and historic preservation law, in relation to allowing advertising structures in the Niagara Falls state park PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to allow signs on land within 500 feet of the border of the Niagara Falls state park. SUMMARY OF SPECIFIC PROVISIONS: This bill adds subdivision 2-a to section 13.07 of the parks, recreation and historic preservation law to exempt the Niagara Falls state park from the provisions of the section. JUSTIFICATION: Unnecessary restrictions have an adverse effect on businesses and economic development. Current law prohibits signage within 500 feet of the Niagara Falls state park unless the business obtains a permit from the NYS Office of Parks, Recreation & Historic Preservation. This type of restriction hampers business activity in the area, and should be a decision that is made by the local municipality. This bill will remove this state restriction on business signage near Niagara Falls state park while keeping the local permitting process

MAZIARZ, GRISANTI -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the parks, recreation and historic preservation law, in relation to allowing advertising structures in the Niagara Falls state park THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 13.07 of the parks, recreation and historic preser- vation law is amended by adding a new subdivision 2-a to read as follows: 2-A. THE PROVISIONS OF THIS SECTION SHALL NOT APPLY TO THE BORDER OF THE NIAGARA FALLS STATE PARK. S 2. This act shall take effect immediately.
