BILL NUMBER:S6783 TITLE OF BILL: An act to amend the executive law, in relation to authorizing Nassau county to administer and enforce the uniform fire prevention and building code and the New York state energy conservation construction code PURPOSE OR GENERAL IDEA OF BILL: To allow Nassau County to be considered a "local government" for the purposes of enforcing the uniform code. SUMMARY OF SPECIFIC PROVISIONS: Section 383 of the Executive Law is renumbered section 384 and a new section 383 is added. JUSTIFICATION: The Nassau County Fire Marshal's office has been enforcing fire codes within the county since 1940. The local building departments were never set up to enforce fire codes. Nassau County is unique within the state so as there is only one agency administering and enforcing fire codes. Builders only have to go to one place to take care of the fire code requirements instead of having to go to each different municipality and deal with each municipality requirements.

MARTINS -- read twice and ordered printed, and when printed to be committed to the Committee on Housing, Construction and Community Development AN ACT to amend the executive law, in relation to authorizing Nassau county to administer and enforce the uniform fire prevention and building code and the New York state energy conservation construction code THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 383 of the executive law is renumbered section 384 and a new section 383 is added to read as follows: S 383. AUTHORIZING NASSAU COUNTY TO ADMINISTER AND ENFORCE THE NEW YORK STATE UNIFORM FIRE PREVENTION AND BUILDING CODE AND THE NEW YORK STATE ENERGY CONSERVATION CONSTRUCTION CODE. 1. NASSAU COUNTY MAY ADOPT A LOCAL LAW OR RESOLUTION AUTHORIZING THE ADMINISTRATION AND ENFORCEMENT OF THE UNIFORM FIRE PREVENTION AND BUILDING CODE AND THE STATE ENERGY CONSERVATION CONSTRUCTION CODE IMMEDIATELY. 2. UPON THE ADOPTION OF SUCH LOCAL LAW OR RESOLUTION, NASSAU COUNTY SHALL HAVE THE SAME POWERS, DUTIES AND REMEDIES AS ANY LOCAL GOVERNMENT PURSUANT TO THIS ARTICLE. S 2. This act shall take effect immediately. Effective immediately, the addition, amendment and/or repeal of any rule or regulation neces- sary for the implementation of this act on its effective date is author- ized to be made on or before such date.
