BILL NUMBER:S6827 TITLE OF BILL: An act to amend the election law, in relation to prohibiting certain voters from attendance at certain polling places PURPOSE: This bill prohibits registered sex offenders from voting at schools provided that the county board of elections has designated an alternate polling place. SUMMARY OF PROVISIONS: Adds section 8-108 to the election law to prohibit sex offenders from voting at schools. JUSTIFICATION: The protection of children from harm that may be inflicted on them by sex offenders is of paramount importance to our society. Those convicted of sex offenses are generally prohibited from school grounds and other areas where children should be secure. This prohibition, however, can come into conflict with a sex offender's fundamental right to vote when their designated polling place is a school. This bill will give County Board of Elections the ability to designate alternate polling locations for sex offenders when their regular polling location is a school. This will provide protection for our children while maintaining everyone's fundamental right to vote.

O'MARA, RANZENHOFER, RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Elections AN ACT to amend the election law, in relation to prohibiting certain voters from attendance at certain polling places THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The election law is amended by adding a new section 8-108 to read as follows: S 8-108. PROHIBITED ATTENDANCE OF CERTAIN VOTERS. A VOTER WHO HAS BEEN CONVICTED OF A SEX OFFENSE UNDER ARTICLE 130 OF THE PENAL LAW AND WHO IS OTHERWISE ELIGIBLE TO VOTE SHALL BE PROHIBITED FROM ATTENDANCE AT POLL- ING PLACES LOCATED WITHIN SCHOOLS; PROVIDED, HOWEVER, THAT THE COUNTY BOARD OF ELECTIONS SHALL PROVIDE AN ALTERNATE POLLING PLACE FOR SUCH VOTER TO CAST HIS OR HER BALLOT. S 2. This act shall take effect on the first of November next succeed- ing the date upon which it shall have become a law.
