TITLE OF BILL:
An act
providing for the creation of a temporary state commission on the energy
costs savings for school districts and providing for the repeal of such
provisions upon the expiration thereof

PURPOSE OR GENERAL IDEA OF THE BILL:
Provides for the creation of a
temporary state commission on alternative energy cost saving for
school in New York State.

SUMMARY OF SPECIFIC PROVISIONS:
Section 1: A temporary commission, to be known as the Commission on
Alternative Energy Cost Saving for Schools in New York State,
hereinafter referred to as the commission, is hereby created to
examine, evaluate, make recommendations and to collect data
concerning the cost saving of school districts if each school
utilized alternative energy technologies.

Section 2: The commission shall consist of 15 members, to be appointed
as follows: nine members to be appointed by the government, four of
which shall be staff from NYSERDA and/or the New York state
department of education and five of which shall be member of green
energy technology firms.

Section 3: The commission will be housed at NYS Energy Research and
Development Authority.

Section 4: Members of the commission shall receive no compensation for
their services, but shall be allowed their actual and necessary
expenses incurred in the performance of their duties.

Section 7: The commission shall make and submit its finding, including
any recommendation for legislative action as it may deem necessary
and appropriate in a report to the government and the heads of the
legislature and administrators of school districts within 270 days of
convening of the Commission on Alternative Energy Costs Savings for
Schools in New York State.

JUSTIFICATION:
New York's troubled economy and the resulting fiscal constraints under
which local districts must now contend with provide all the incentive
the state needs to commit itself to the creation, retrofitting and
maintenance of green schools. There are, for example, about 5,410
acres of mostly flat-roofed school buildings statewide that can
easily accommodate solar panels to reduce energy costs. The solar
power generated by that much space could yield 12,550,900 KWH per
day, resulting in roughly $1.25 million worth of energy daily. A move

toward greener schools is not only one that is environmentally
friendly, but also one that is economically sound.

The potential for all school districts to completely eliminate their
electricity and natural gas costs is completely possible if modern
alternative energy technologies are adopted and proliferate throughout
the more than 4,200 school buildings in New York's 700 school
districts.

New advances in miniature wind turbines that can be attached to the
roofs of school buildings and more efficient solar energy panel can
eliminate school energy bills which currently range from almost one
million dollars annually to the tens of millions in larger districts
and several hundred million annually in New York City alone.

A mass scale retrofitting of school buildings with green energy
technologies could create some 40,000 temporary jobs and some 3,500
permanent jobs in communities across New York.

In addition, training at community college level for green jobs would
be complemented by actually creating the jobs graduates from such
programs will need.

The potential to incorporate STEM curriculum while retrofitting each
school can be realized.

The positives of moving swiftly and diligently on this issue are
tremendous and can help offset cuts to critically needed education
programs and prevent reductions in teaching staff and student support
services.

None. Bonding
could be suggested either at the local level or by a state bonding
program to pay for deployment of green technologies that will
permanently eliminate energy bills for all school districts, while

This act shall take effect immediately.

AN ACT providing for the creation of a temporary state commission on the
  energy costs savings for school districts and providing for the repeal
  of such provisions upon the expiration thereof

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. A temporary state commission, to be known as the commission
on  alternative energy cost savings for schools in New York state, here-
inafter referred to as the commission, is hereby created to, in  consul-
tation  with the New York state department of education, examine, evalu-
ate, make recommendations  and  to  collect  data  concerning  the  cost
savings  of  school districts if each school utilized alternative energy
technologies including but not limited to, solar  panels  and  advanced-
technology miniature wind turbines, to help offset energy cost currently
incurred by each school.
  S  2. The commission shall consist of fifteen members, to be appointed
as follows: nine members to be appointed by  the governor, four of which
shall be staff from the New York state department of  education  or  the
New  York  state  energy  research and development authority and five of
which shall be members of green energy  technology  firms  and  environ-
mental  conservation not-for-profit organizations operating in the state
of New York; two members to be appointed by the temporary  president  of
the  senate; two members to be appointed by the speaker of the assembly;
one member to be appointed by the minority leader of the senate; and one
member to be appointed by the minority leader of the assembly.
  S 3. The commission shall be housed at and staffed  by  the  New  York
state  energy  research  and  development  authority. The governor shall
designate the chairperson and vice-chairperson of the commission. Vacan-
cies in the membership of the commission and among its officers shall be
filled in the manner provided for original appointments or designations.
  S 4. Members of the commission shall receive no compensation for their
services, but shall be  allowed  their  actual  and  necessary  expenses
incurred  in  the  performance of their duties hereunder. To the maximum

extent feasible, the commission shall be entitled to request and receive
and shall utilize and be provided with such facilities,  resources,  and
data  of  any court, department, division, board, bureau, commission, or
agency  of  the  state  or any political subdivision thereof as it deems
necessary or desirable to carry out properly its powers and duties here-
under.
  S 5. The commission may employ and at pleasure remove  such  personnel
as  it  may  deem necessary for the performance of its functions and fix
their compensation within the amounts made available therefor.
  S 6. The commission may meet within and outside the state, shall  hold
public  hearings, and shall have all the powers of a legislative commit-
tee pursuant to the legislative law.
  S 7. The commission shall make and submit its findings, including  any
recommendations  for  legislative  action  as  it may deem necessary and
appropriate in a report to the governor, the temporary president of  the
senate,  the  speaker of the assembly, the minority leader of the senate
and the minority leader of the  assembly,  the  New  York  state  school
boards association and the council of school supervisors and administra-
tors  not  later  than two hundred seventy days after it first convenes.
Such report shall include recommendations for:
  1. the alternative energy technologies that should be used;
  2. mechanisms for funding a rapid implementation and  construction  of
such energy saving systems;
  3.  the  potential for school districts to feed excess energy capacity
into the electricity grid and projected revenue from such;
  4. the short term construction costs;
  5. the long-term maintenance costs;
  6. the potential to reduce school property taxes;
  7. the projected energy costs savings per school district;
  8. the number of short-term job creation for this green initiative;
  9. the number of long-term job creation for this green initiative;
  10. the projected timeline to outfit the more than 4,200 public school
buildings in the state with such technology;
  11. the projected reduction in greenhouse gases  if  this  project  is
implemented statewide;
  12.  the  ability for school districts to sell excess power generation
capacity to utility companies and local community; and
  13. the ability of schools to use the implementation of  green  energy
alternatives  as a tool for classroom instruction in their science, math
and technology curriculum.
  S 8. This  act  shall  take  effect  immediately;  provided  that  the
appointment  of  members  to  the  commission on alternative energy cost
savings for schools in New York state shall be completed  within  thirty
days  of  such  effective  date,  provided  further, that this act shall
remain in effect until thirty days after the commission  on  alternative
energy  cost  savings  for  schools in New York state submits the report
required by section six of this act, at which time this act shall expire
and be deemed repealed; and provided further, however, that  the  chair-
person  of  the  temporary  state  commission on alternative energy cost
savings for schools in New York state shall notify the legislative  bill
drafting commission upon the submission of its report as provided for in
section  six  of  this  act in order that the commission may maintain an
accurate and timely effective data base of the official text of the laws
of the state of New York in furtherance of effecting the  provisions  of
section  44  of the legislative law and section 70-b of the public offi-
cers law.

  2. THE AUTHORITY SHALL CREATE A REPORT, CONTAINING THE INFORMATION AND
DATA COLLECTED PURSUANT TO  SUBDIVISION  ONE  OF  THIS  SECTION,  TO  BE
SUBMITTED  TO  THE  GOVERNOR, THE TEMPORARY PRESIDENT OF THE SENATE, THE
SPEAKER OF THE ASSEMBLY, THE MINORITY  LEADER  OF  THE  SENATE  AND  THE
MINORITY  LEADER  OF  THE  ASSEMBLY NO LATER THAN JULY THIRTY-FIRST, TWO
THOUSAND THIRTEEN.
  3. SUCH REPORT, AT A MINIMUM, SHALL INCLUDE:
  A. THE ALTERNATIVE ENERGY TECHNOLOGIES THAT SHOULD BE USED;
  B. MECHANISMS FOR FUNDING A RAPID IMPLEMENTATION AND  CONSTRUCTION  OF
SUCH ENERGY SAVING SYSTEMS;
  C.  THE  POTENTIAL FOR SCHOOL DISTRICTS TO FEED EXCESS ENERGY CAPACITY
INTO THE ELECTRICITY GRID AND PROJECTED REVENUE FROM SUCH;

TITLE OF BILL:
An act to amend the public authorities law, in relation to requiring the
power authority of the state of New York produce a report detailing best
practices with regard to energy cost savings for schools; and providing
for the repeal of such provisions upon expiration thereof

PURPOSE OR GENERAL IDEA OF THE BILL:

Provides for a detailed report on potential school energy savings if
school districts where to Implement alternative energy technologies.

SUMMARY OF SPECIFIC PROVISIONS:
Section 1: Amends the public authorities law in relation to requiring
the New York State Energy Research and Development Authority to create a
report on energy cost savings for school districts.

Section 2: The report shall be submitted to the Governor, the Temporary
President of the Senate, the Speaker of the Assembly, and minority lead-
ers of the Senate and Assembly no later than July 31 of 2013.

Section 3: Itemizes information required but not limited to be covered
by the report.

JUSTIFICATION:

New York's troubled economy and the resulting fiscal constraints under
which local districts must now contend with provide all the incentive
the state needs to commit itself to the creation, retrofitting and main-
tenance of green schools. There are, for example, about 5,410 acres of
mostly flat-roofed school buildings statewide that can easily accommo-
date solar panels to reduce energy costs. The solar power generated by
that much space could yield 12,550,900 KWH per day, resulting in roughly
$1.25 million worth of energy daily. A move toward greener schools is
not only one that is environmentally friendly, but also one that is
economically sound.

The potential for all school districts to completely eliminate their
electricity and natural gas costs is completely possible if modern
alternative energy technologies are adopted and proliferate throughout
the more than 4,200 school buildings in New York's 700 school districts.

New advances in miniature wind turbines that can be attached to the
roofs of school buildings and more efficient solar energy panels can
eliminate school energy bills which currently range from almost one
million dollars annually to the tens of millions in larger districts and
several hundred million annually in New York City alone.

A mass scale retrofitting of school buildings with green energy technol-
ogies could create some 40,000 temporary jobs and some 3,500 permanent
jobs in communities across New York.

In addition, training at community college level for green jobs would be
complemented by actually creating the jobs graduates from such programs
will need.

The potential to incorporate STEM curriculum while retrofitting each
school can be realized.

The positives of moving swiftly and diligently on this issue are tremen-
dous and can help offset cuts to critically needed education programs
and prevent reductions in teaching staff and student support services.

FISCAL IMPLICATIONS FOR STATE AND LOCAL GOVERNMENT:
None. Bonding could be suggested either at the local level or by a state
bonding program to pay for deployment of green technologies that will
permanently eliminate energy bills for all school districts, while
creating thousands of jobs.

EFFECTIVE DATE:
This act shall take effect immediately and expire on July 31, 2013.

AN ACT to amend the public authorities law, in relation to requiring the

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph (f) of subdivision 17  of  section  1005  of  the
public  authorities law, as added by chapter 477 of the laws of 2009 and
such subdivision as renumbered by section 16 of part CC of chapter 60 of
the laws of 2011, is amended to read as follows:
  (f) The authority shall complete and submit a  report,  on  or  before
[January  thirty-first,  two thousand twelve, on those activities under-
taken pursuant to this subdivision to the governor, the speaker  of  the
assembly,  the temporary president of the senate, the minority leader of
the senate, the minority leader of the assembly, the chair of the senate
finance committee, the chair of the assembly ways and  means  committee,
the  chair  of the assembly energy committee and the chair of the senate
energy committee.] JULY THIRTY-FIRST, TWO THOUSAND  THIRTEEN,  DETAILING
BEST  PRACTICES  FOR  ENERGY  COST SAVINGS FOR SCHOOL DISTRICTS BASED ON
DATA OBTAINED THROUGH ACTIVITIES UNDERTAKEN PURSUANT TO THIS SUBDIVISION
TO THE GOVERNOR, THE SPEAKER OF THE ASSEMBLY, THE TEMPORARY PRESIDENT OF
THE SENATE, THE MINORITY LEADER OF THE SENATE, THE  MINORITY  LEADER  OF
