TITLE OF BILL:
An act to amend the alcoholic beverage control law, in relation to
authorizing the retail sale of alcoholic beverages at certain stadiums,
arenas or places of entertainment at eleven a.m. on Sunday
PURPOSE OR GENERAL IDEA OF BILL:
This legislation would allow certain stadiums, arenas, or places of
entertainment starting at 11 A.M. on Sundays.
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 would allow stadiums, arenas. or places of entertainment
having a permanent seating capacity in excess of 5,000 who are licensed
to sell for on premises consumption be able to sell for on-sale consump-
tion starting at 11 A.M., as opposed to 12 A.M. as under current law.
Section 2 is the effective date.
JUSTIFICATION:
Major sporting events often occur at 1 P.M. on Sundays in New York. The
ability for ticket holders to enter into the arena usually is allowed to
occur hours before game time. By allowing spectators to enter into the
stadium and purchase alcohol directly from the stadium if they so choose
you allow for greater oversight. Inside these facilities employees are
trained how to serve individuals responsibly and would be able to

AN ACT to amend the alcoholic beverage control law, in relation to
authorizing the retail sale of alcoholic beverages at certain stadi-
ums, arenas or places of entertainment at eleven a.m. on Sunday
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Subdivision 5 of section 106 of the alcoholic beverage
control law, as amended by chapter 83 of the laws of 1995, is amended to
read as follows:
5. No alcoholic beverages shall be sold, offered for sale or given
away upon any premises licensed to sell alcoholic beverages at retail
for on-premises consumption, during the following hours:
(a) Sunday, from four ante meridiem to twelve noon.
(b) On any other day between four ante meridiem and eight ante meri-
diem.
Unless otherwise approved by the authority pursuant to subdivision
eleven of section seventeen of this chapter, where any rule has been
adopted in a county on or before April first, nineteen hundred ninety-
five, further restricting the hours of sale for alcoholic beverages,
such restricted hours shall be the hours, during which the sale of alco-
holic beverages at retail for on-premises consumption shall not be
permitted within such county.
Nor shall any person be permitted to consume any alcoholic beverages
upon any such premises later than one-half hour after the start of the
prohibited hours of sale provided for in this section.
NOTWITHSTANDING PARAGRAPH (A) OF THIS SUBDIVISION, NO ALCOHOLIC BEVER-
AGES SHALL BE SOLD, OFFERED FOR SALE OR GIVEN AWAY AT ANY STADIUM, ARENA
OR PLACE OF ENTERTAINMENT HAVING A PERMANENT SEATING CAPACITY IN EXCESS
OF FIVE THOUSAND PERSONS, LICENSED TO SELL ALCOHOLIC BEVERAGES AT RETAIL
FOR ON-PREMISES CONSUMPTION ON SUNDAY, FROM FOUR ANTE MERIDIEM TO ELEVEN
ANTE MERIDIEM.
S 2. This act shall take effect immediately.
