BILL NUMBER:S7214

TITLE OF BILL:
An act
in relation to the conveyance of land formerly used as an armory to the
town of Huntington, county of Suffolk

PURPOSE OR GENERAL IDEA OF BILL:
To direct the Commissioner of General
Services to transfer and convey approximately 3.6 acres of land
formerly used as the Huntington Station Armory to the Town of
Huntington to enhance its ongoing efforts to revitalize the
Huntington Station area.

SUMMARY OF SPECIFIC PROVISIONS:
Section 1 authorizes the commissioner of General Services to transfer
and convey to the town of Huntington in the consideration of one
dollar, approximately 3.6 acres of land.

Section 2 gives the meets and bound of the armory property to be
conveyed.

Section 3 requires the town of Huntington to file an application to
the commissioner of General Services within one year of the effective
date of this act.

Section 4 describes the purposes to which the town of Huntington will
be using this property. The town will utilize the property for
structures and improvements by several departments of the town
including parks and recreation, engineering, general services, public
safety, human and youth service in connection with recreational,
community and civic programs. Upon the termination of said use, the
land shall revert to the State.

Section 5 is the effective date.

JUSTIFICATION:
Since 2009, when the New York State Division of Military
and Naval Affairs decided as part of the Department of Defense Base
Realignment and Closure recommendations, to relocate the New York
Army National Guard units housed at the Huntington Station Armory,
the Town of Huntington has had a long-standing interest in the Armory
property, which is located adjacent to a town recreational facility
at Manor Field Park.

As part of its on going effort to revitalize the Huntington Station
area, the town recently invested over $2 million to rehabilitate the
Manor Field Park, adding synthetic turf field, new lighting and
bleachers, and other improvements.

The Town will incorporate the Armory property into the existing park.
The Armory building would house park support operations and the space
is well suited to offer enhanced programming for the Huntington
Station community with other Town departments which also serve this
community's needs.
Merging the Armory property into the park would help accelerate
Huntington Station revitalization and restore a Town presence through
community development.

EFFECTIVE DATE:
This act shall take effect immediately.

AN ACT in relation to the conveyance of land formerly used as an  armory
  to the town of Huntington, county of Suffolk

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subject to the provisions of this act  but  notwithstanding
any  other provision of law to the contrary, the commissioner of general
services is hereby authorized to transfer and  convey  to  the  town  of
Huntington in consideration of one dollar and upon such other conditions
as  the  commissioner  may  deem proper, approximately 3.6 acres of land
formerly used as an armory, and further described in section two of this
act.
  S 2. The lands authorized by this act to be transferred  and  conveyed
are as follows:
  All  that  certain  plot,  piece  or parcel of land situate, lying and
being at Huntington Station, Town of Huntington, County of  Suffolk  and
State  of  New  York,  known  and  designated  as  Lots 286-296 and Lots
344-354, both inclusive in Block G, Lots 297-310 and Lots 355-368,  both
inclusive  in  Block H, Lots 227-240, both inclusive in Block E, and the
portion of the road bed of East Fourth Street lying east of the easterly
line of Wicks Avenue between Blocks E and H, and the portion of the road
bed of Wicks Avenue lying between  the  northerly  line  of  East  Fifth
Street,  on  the  south, and the southerly line of East Fourth Street on
the north as shown on a certain map entitled Map of "Gardiner Lawns" and
filed in the Office of the Clerk of the County of Suffolk  on  July  16,
1926 as Map Number 812. Said parcel being more particularly described as
follows:
BEGINNING  at a point on the northerly line of East Fifth Street distant
380.00 feet easterly along said line from the intersection of the  east-

erly  line of Lloyd Avenue (not open). Running thence from said point of
BEGINNING the following courses;  North 18 degrees 39 minutes 30 seconds
West, 200.00 feet to the southerly line  of  said  East  Fourth  Street.
Thence  easterly along said line, North 71 degrees 20 minutes 30 seconds
East, 270.00 feet to a point on  the  easterly  line  of  Wicks  Avenue.
Thence northerly along said line, North 18 degrees 39 minutes 30 seconds
West, 153.89 feet to a point on the southerly line of land as shown on a
certain  map entitled "Map of Cobblestone Estates, Section 1".  Said map
being filed in the Office of the Clerk  of  the  County  of  Suffolk  on
November 22, 2000 as Map Number 10539.
RUNNING  thence  easterly  and southerly along said land the following 2
courses; 1) North 69 degrees 10 minutes 50 seconds  East,  280.96  feet;
thence,  2)  South 20 degrees 13 minutes 10 seconds East, 364.62 feet to
the northerly line of said East Fifth Street. Thence westerly along said
line, South 71 degrees 20 minutes 30 seconds West, 560.69  feet  to  the
point or place of BEGINNING.
Said parcel having an area of 3.596 acres more or less.
  S 3. The commissioner of general services shall not transfer or convey
the  aforesaid land unless application is made by the town of Huntington
within one year after the effective date of this act.
  S 4. Any lands transferred pursuant to this act shall be used for  the
purposes  of  the  town  of  Huntington to utilize the subject property,
structures and improvements thereto by several departments of  the  town
including  parks  and  recreation, engineering, general services, public
safety, human and youth service in connection with recreational,  commu-
nity and civic programs appropriate to the location and structures, upon
termination of which use or uses title to the lands so transferred shall
revert to the state of New York.
  S 5. This act shall take effect immediately.
